온라인콘텐츠의 선의취득에 관한 법리

지적산물의 재산권성은 20세기 이후 지속적으로 강화되어 왔지만 최근에는 디지털콘텐츠와 인터넷의 발전으로 인하여 보호의 범위와 수준이 급속히 높아지고 있다. 그러나 디지털기술은 저작물의 특성을 달리하게 하였고 인터넷의 발전은 저작권보호의 한계를 드러내면서 디지털콘텐츠의 이용관계에서 사회적 갈등을 일으키고 있다. 저작권은 국내외의 법제에 의하여 이미 소유권에 상당하는 강력한 재산권으로 확립되었다. 저작권법에서도 저작권은 저작물을 지배하는 저작권자 등의 권리관계, 저작권과 공공의 이익이라는 측면을 중심으로 논의되어 왔다. 현재 우리나라의 저작권법도 저작물에 대한 저작자 등의 지배관계, 공공의 이익과 저작권의 조화라는 부분에 중심을 두고 있다. 그러나 지적산물이 존재하는 형식이나 제공하고 이용하는 환경의 개별적 특별함을 고려한다면, 저작권의 권리체계에서 각론적 고민을 심각하게 할 필요가 있다. 이러한 고민은 공공성또는 문화발전을 이유로 저작권을 제한하는 것과는 전혀 다른 문제이다. 디지털콘텐츠는 특정한 지적 산물임에도 불구하고 특히 온라인에서는 아주 쉬운 접근으로 타인에 의하여 복제되며 저작권자와 무관하게 이용이 가능하다. 그러므로 저작권이용관계의 공정성을 위하여, 저작권자는 콘텐츠이용자에 대하여 이용권의 내용을 명시할 상당한주의의무를 부담하여야 하며, 온라인콘텐츠의 이용관계에서 특약이 없는 한 무상성의 원칙을 확립하여야 하고, 선의의 거래자를 보호하기 위하여 민법의 선의취득이론을 디지털콘텐츠의 거래에도 도입할 필요가 있다. 21세기에 들어오면서, 지적산물은 저작권자의 지배관계가 아니라 콘텐츠이용관계를 중심으로 변화하고 있고 전통적인 저작권보호의 관념과 규범적 갈등을 일으키고 있다. 저작권 관련한 갈등을 해소하는 근본적인 대안으로는, 다양한 지적산물의 특성에 의하여 발생하는 콘텐츠거래관계에서 거래안전과 이용자보호와 관련한 부분을 포함한 각론적 저작권체계를 확립할 필요가 있다.
Abstract
After the 20th century, level of protection for intellectual property rights is due to the development of digital content and the Internet. Copyright is quite strong as the ownership of property rights by international and domestic legislation. But digital technology and the Internet development is exposing the limitations of the copyright protection. Considering the uniqueness of the environment seriously, I consider of some particular problems in copyright system. Yet this dilemma represents an entirely different matter from restricting the copyright on the grounds of a public or cultural development. Therefore, for the fairness of the use of copyright, copyright holders due attention to specify the content of access. And also principles of free and the bona fide acquisition shall be established. From the 21st century, intellectual products is not domination of the copyright owner but the relationship of users. Alternative methods of the fundamental conflict, I think that a system of copyright is based on the type of transactions for trade safety and a user protection.
