영미법상 불편관할(Forum Non-conveniens) 법리와 관할권 선택(Forum Shopping)을 통한 실질적 정의의 확장

초록

미국에서는 통일상법전 등의 예외가 있기는 하나 일반적으로 주마다 법이 각각 다르다. 그래서 여러 주 사이의 분쟁 즉, 복수의 주를 둘러싼 분쟁에 관해서는 관할법원과 준거법을 결정할 필요가 있다. A주의 법이 무거운 손해배상 책임을 인정하고 있거나 또는 B주의 법에 의하면 재판상 이혼을 쉽게 인정받을 수 있는 경우 당해 주 외에 사는 사람이 스스로 보다 유리한 판결을 받을 수 있으므로 이들 주 법원에 소송을 제기할 수 있다. 특히 재판상 이혼을 쉽게 인정하는 것으로 네바다 주는 많이 알려져 있다. 무엇보다 B주에서 재판이 이루어지더라도 B주 주법이 적용되지는 않기 때문에 (요컨대, B주에서 실시된 재판에서는 B주의 실체법이 적용되는 것은 아니다), 소송당사자에게 반드시 유리한 판결이 내려지는 것은 아니다. 사건의 해결을 위해 적용되는 실체법은 충돌법(저촉법 혹은 국제사법)에 근거하여 결정되는 것이지만, 결과적으로 법정지의 실체법이 적용되는 경우가 많다. 이처럼 법정지의 실체법이 원고에게 유리하다는 이유로 그 땅과의 관련성이 적은데도 그곳의 법원에 소송이 제기되는 경우가 많다. 이를 무한정 인정하게 되면 어느 특정 법정지에 소송이 집중하게 되는데 이를 “관할권 선택”(forum shopping)이라 하고 이는 당사자가 법정지를 뒤지고 다니는 현상으로서 공정한 재판을 방해할 수 있기 때문에 인정하지 않는다. 예를 들어 미국에서는 ① 다른 나라 또는 주도 재판관할권을 가지면서, ② 그 나라 또는 주에서 재판을 하는 것이 편리할 경우에는 미국법원이 재판을 하지 않는다는 실무관행을 확립하고 있다. 이를 불편관할(forum non convenience)의 원칙이라 한다. 요건 ①의 취지는 제소가 어느 나라 또는 주의 법원에도 계속되지 않는다는 불편을 회피하는 데 있다. 본고는 이러한 영미법에서 인정되는 불편관할이 오늘날 세계화된 지구촌에서 개도국이나 저개발국 사람들의 영미 기업이나 그 국가를 상대로 제기한 소송에서 어떻게 작용하며 기능하고 있는지 검토하였다.

Abstract

Literally, forum non conveniens means simply “inconvenient forum” for the litigant. It does not refer to a judicial forum that is improper; rather it refers to a judicial forum that is inconvenient or not as appropriate as another forum may be. To exercise the doctrine of forum non conveniens, an adequate alternate forum in which the case may be heard is essential. The burden to prove the existence of such an alternate forum is on the party who moves to transfer the case for forum non conveniens, usually the defendant. Without an alternate forum, the case must remain in the original forum, no matter how inconvenient it may be. Such a forum must be willing to hear the case, and the defendant must be able to be served with process within the alternate forum. To determine whether another forum is an adequate alternative, the court must determine whether the alternate forum will hear the case, and whether the defendants may be served with process in the alternate forum. Usually, the latter depends on the jurisdiction of the alternate forum over the defendants. Because it is usually the defendants who move to transfer the case to the alternative forum, the defendants will often consent to such jurisdiction. If the defendants refused to consent, the case would remain in the original forum, which is exactly what the defendants were attempting to avoid. In situations where the defendant seeks to employ the doctrine of forum non conveniens and names a court in a foreign country as an alternative forum, the original U.S. court will take many factors into consideration, such as: whether the foreign court will apply American substantive law; whether the plaintiff will be prejudiced by transfer to a foreign court; and whether the foreign court will be fair. It should be noted, however, that the plaintiff’s initial choice of forum is given deference. Even if there are more reasons to grant the motion for forum non conveniens than to deny it, the deference may still control and the court may hold on to the case. The reasons to grant the motion to move the case must be extremely persuasive. There are two types of factors the court will take into account when considering a forum non conveniens motion: public interest and private interest. Public interest factors include: “(1) having local disputes settled locally; (2) avoiding problems of applying foreign law; and (3) avoiding burdening jurors with cases that have no impact on their community.” Another factor to consider is whether another group of citizens has a greater interest in deciding the case than those of the original forum. Finally, another consideration is whether a judgment by one court will have to be enforced in another jurisdiction, which can create more legal hurdles; it may make more sense to have the other jurisdiction decide the case in the first place. Factors concerning private interests include: “(1) ease of access to evidence; (2) the cost for witnesses to attend trial; (3) the availability of compulsory process; and (4) other factors that might shorten trial or make it less expensive.” The court may not raise lack of personal jurisdiction over a party on its own, that is, sua sponte. However, the court may invoke the doctrine of forum non conveniens sua sponte, that is, without the issue being raised by a party. As mentioned above, the doctrine of forum non conveniens can be employed when the venue, albeit proper, is inappropriate, inconvenient, or unacceptable for various reasons. It is for a court to determine, on a case by case basis, whether it is the proper venue in which to hear the action. This is true even though it has jurisdiction over the parties, jurisdiction over the subject matter of the case, and is a proper venue in which the action can be brought. When a forum non conveniens motion is granted, the case is not dismissed; instead, pursuant to 28 U.S.C. §1404(a), the case is transferred to the adequate alternative forum.
