노동조합의 조직형태 변경은 1997년 「노동조합 및 노동관계조정법」(이하 ‘노조법’이라 한다)의 제정 시 도입되어 기업별 노동조합이 산업별 노동조합의 지부 등으로 전환하는데 활발히 이용되었다. 최근에는 산업별 노동조합의 지부나 분회 등이 다시 기업별 노동조합으로 전환하는데 조직형태 변경을 이용하게 되면서 다시금 주목을 받고 있다. 최근 대법원은 전원합의체판결을 통해 산업별 노동조합의 지부, 분회 등 산하조직이 비법인사단(근로자단체)으로서 노동조합에 준하는 실체를 갖는 경우 독자적으로 조직형태 변경을 결의할 수 있다고 판시함으로써 그간 논란이 되었던 조직형태 변경의 주체로서 노동조합의 개념을 분명히 하였다. 2006년 「공무원의 노동조합 설립 및 운영 등에 관한 법률」(이하 ‘공무원노조법’이라 한다)이 시행되면서 공무원도 제한적인 범위에서 노동조합을 조직하고 활동하는 것이 허용되었다. 그러나 조직형태 변경에 관한 사례나 이에 관한 연구는 아직 부족한 실정이다. 조직형태 변경에 관한 노조법의 규정은 공무원노조에도 동일하게 적용되므로, 조직형태 변경을 둘러싼 법적 쟁점에는 큰 차이가 없다. 다만 헌법과 공무원노조법, 국가공무원법, 지방공무원법 등 관련법령은 공무원노조활동에 대한 특별한 규율을 예정하고 있어 이러한 범위 내에서 공무원노동조합의 조직형태 변경에도 특수성이 존재하게 된다. 본고에서는 이러한 공무원노조의 조직형태 변경의 특수성을 밝히고자 하며 이를 위해 3개의 대표적 사례를 검토한다. 이 사례들은 공무원노조법에 따라 적법하게 설립된 노동조합이 아닌 비합법단체의 지부가 조직형태 변경의 주체가 될 수 있는지, 합법노조에서 비합법단체로의 조직형태 변경도 허용될 수 있는지 같은 공무원노동조합에 특유한 쟁점에 관한 것들이다. 관련법령은 공무원의 신분상 특수성을 고려해 공무원의 노동운동을 원칙적으로 금지하고, 공무원노조법에 따라 설립된 공무원노동조합의 정당한 활동만을 보호하고 있다. 공무원노동조합의 조합활동으로서 공무원노동조합의 조직형태 변경도 이러한 한계를 준수하여야 함은 당연하다. 따라서 현행법상 노동운동을 할 수 없는 비합법단체로의 조직형태 변경은 단결력의 강화 등 조직형태 변경의 인정 취지에 반하고, 조합활동으로서 목적의 정당성도 결여된 것이란 점에서 원칙적으로 허용될 수 없다고 본다.
Abstract
After the labor union structural change was introduced (Article 16, Paragraph 2) in legislating the Trade Union and Labor Relations Adjustment Act in 1997, enterprise trade unions were actively used for conversion to Industrial trade union subordinate bodies. Recently, branches or local chapters of Industrial trade union tend to be converted to enterprise trade union again, and the conversion is paid attention to as the form of structural change was used. Recently, through ‘all members of supreme court judges’ decision,’ the Supreme Court manifested the concept of labor union as the subject of structural change which had been at issue by ruling that they can decide on their structural change if branch organizations including industrial trade union’s branches, local chapters, etc. exclusively have the substantiality of so called labor union as non-corporate worker organizations. In the enforcement of the public officials’ trade union law in 2006, public officials were permitted to organize and perform labor unions. However, there have been few studies on public officials’ labor union structural changes, lacking little accumulation of sufficient cases. It is true that regulations of labor union law regarding structural change are applied for public officials’ trade union in the same way, but there is no big difference in legal issues surrounded (for example, the concept of labor union as the subject of structural change) by structural change. Still, related laws and ordinances such as the public officials’ trade union law predict special regulations on public officials’ trade union activities, and within the domain, there also is a peculiarity of structural change in public officials’ trade union. This study aimed to identify the peculiarity of structural change in public officials’ trade union. For this purpose, this study reviewed three representative cases related with structural change of public officials’ labor union. The cases comprised unique issues in public officials’ labor union such as whether outlawed trade union branches that were not established as a labor union according to the public officials’ trade union law can be the subject of structural change, and in opposition to that, whether a legal labor union can be permitted to make structural change into a outlawed trade union. Related laws including the constitutional law, public officials’ trade union law, national public officials’ law and local public officials’ law in principle prohibit public officials’ labor movement in considering public officials’ peculiarity in social standing, and protect justified activities of public officials’ labor union established according to public officials’ trade union law. As part of labor union activities, it is natural to abide by these boundaries for the structural change of public officials’ labor union. Therefore, it is said that the structural change of public officials’ labor union with no permission of labor movement under the operative laws into outlawed trade union cannot be permissible in principle as it is opposed to the purport of authorization of structural change for solidarity reinforcement, and is lacking in the justice of the objective as union activities.
