성범죄자 처벌을 위한 정책수단의 효과 비교분석 - 신상정보공개제도, 전자감시제도, 화학적 거세 제도를 중심으로 -

본 연구에서는 성범죄자를 처벌하기 위해 시행되고 있는 정책수단인 신상정보공개제도, 전자감시제도, 화학적 거세 제도의 효과를 분석하였다. 기존의 성범죄 예방 정책 효과를 분석한 연구들이 정책도입 자체에만 초점을 두어 분석하였다는 한계를 보완하기 위하여, 본 연구에서는 억제이론에 근거하여 개정 및 집행에 따른 효과까지 고려하여 분석을 시도하였다. 이를 위해 제주도를 제외한 전국 54개 보호관찰소를 대상으로 2006년부터 2013년까지 8개 년도의 패널데이터 자료를 구축하여 분석을 수행하였다. 분석결과에 따르면, 신상정보공개제도, 전자감시제도, 화학적 거세 제도의 도입, 개정, 집행은 전체 성폭력과 20세 이하 성폭력을 감소시키는데 통계적으로 유의미한 영향력을 미치지는 못하였으며, 다만 전자감시제도와 화학적 거세 제도의 개정은 성폭력 동종재범율을 감소시키는데 효과가 있는 것으로 확인되었다. 이러한 분석결과를 토대로 성범죄 예방을 위한 정책수단의 효율적인 운영 및 관리 측면에서의 정책적 제언을 제시하였다.
Abstract
This study analyzed the effect of policies, The Disclosure System of Personal Information of Sexual Offenders, The Electronic Monitoring System, and Chemical Castration, in force to punish sex offenders. For this, this research used panel data regression based on measured data on 54 probation offices in KOREA from 2006 to 2013. With regard to the general deterrence effect of the policies, the study results indicate that the electronic monitoring system and the chemical castration of sex offenders have been effective in decreasing the sexual assault recidivism rate. After the review of the results of the empirical analysis policy implication on efficient operation and management of the policy tools for sexual assault prevention was proposed.
