특허권과 관련하여 발명의 발명자가 누구인가? 특허권에서 발명의 발명자라고 주장하는 자는 과연 진실한 발명자인가? 이러한 특허권의 발명을 한 사람이 누구인가에 대해서는 근래 공동연구·개발 프로젝트의 증가와 더불어 많은 논란의 대상이 되고 있다. 그 이유는 현행 특허법에서 발명자 내지 발명자의 인정기준에 대하여 명확한 규정을 두고 있지 않기 때문이다. 따라서 본 논문은 발명자의 실체적 인정기준 및 발명자의 인정에 관련한 사례인 대판 2012. 12. 27, 선고 2011 다 67705, 67712판결(서울고법 2011. 6. 30. 선고 2010나62415(본소),2010나62422(반소병합) 판결을 검토하고, 이를 토대로 비교법적 검토를 통해 향후 분쟁을 최소화할 수 있는 방안을 마련하고자 하였다 그 결과 발명을 한 자가 누구인가는 특허권 관련 소송사건에서 계속해서 분쟁이 발생할 여지가 있는 문제라고 판단하였다. 그리하여 특허법에 “발명자 및 공동발명자”의 개념과 “공동발명자의 인정기준”을 특허법 등 관련법에 명시적으로 규정하여 발명자 등에 대한 실질적인 판단을 할 수 있도록 함으로써 특허권 관련 분쟁을 최소화할 것을 제안하였다.
Abstract
Who is the true inventors related on patent right? what is the admitting requirements for becoming the true joint inventors? These two aspects are very important problems in patent law. I think that these problems have been occurring constantly in the future as well as the past and the present with growth on the joint research and development project. Nevertheless, I was very shocked when I knew the facts that have no any provisions such as definition of inventor, admitted requirement of inventor or joint inventors etc. in the our current patent law. Of course, though the several inventor’s formation pattern have mentioned on the guide book related on invention in job service, it is not enough. Therefore, I will try on survey the articles of our domestic patent law as well as cases of the our court and compare with the foreign laws such as U.S., British, Germany and Japan. As the result, I think that we have to amend the related provisions on the definition and admitting requirement of inventor or joint inventors in patent law. If so, we will diminish the related disputes in the matter of judging on the true inventor gradually.
