한국교회의 교회정관(定款)에 대한 실천신학적 과제

Because korea churches there is no historical experience for equivalent to the nation, resolutions of church disputes has been largely dependent on the court of nation. So today amendment and legislation movement of church bylaw in korea church have been progress only on the basis of a positive law and precedents. Even within the church itself, it been has been carried out only in the dimension of democratization or prevention of church conflict. Therefore I am presented practical theological tasks about the legal meaning and implications of law-theology for discourses on church bylaw of what currently is happening in korea church. I understand that the legal meaning of the church bylaw is the situation that civil law has penetrated through articles of association into the church. And I was confirmed the theological meaning of the law-theology that we must mutual respect for civil code and church law because ’the Justice of God’ appear through positive law and Judicial judgments. I proposed that descriptive empirical tasks of church bylaw are emerging cause of discourses on church bylaw, assignment of religious law academics and descriptive on experience in the field of pastoral ministry. Interpretive tasks of church bylaw are church disputes and church bylaw-centered approach to adjudicating, privatization and democratization of church power, theological selectivity of church polity, opacity of church finances and penetration of antagonists and heretic, etc. The law-theological normative tasks of church bylaw are what it happens ensuring the legitimacy of theology and law theology, civil law and church law. Finally, the practical challenges on the church bylaw are the establishment of ‘the Perfect Law’ and the legal leadership, prevention of judicial activitism or judicialization of justice, the political administrative practice of church bylaw and the development task of church law and church bylaw, etc.
