경제민주주의에 대한 헌법재판소의 이해 - 현행 헌법 제119조의 해석을 중심으로

본 연구는 헌정주의 시스템 하에서 경제민주주의는 우리헌법이 결단한 사회운영의 기본원리라는 것에 주목하여 경제민주주의의 정치이념적 표지와 헌법적 의미, 그리고 추상적 헌법조항의 구체화된 해석인 헌법재판소의 경제헌법 판례를 분석하는 것으로 구성되어 있다. 이를 위해 본 논문의 2장에서는 경제민주주의의 이론적 표지를 고찰하고, 그것의 헌법적 반영을 살펴보았다. 경제민주주의의 이론적 표지를 구성하는 것으로는 사회적 시장경제질서‧관리자본주의‧실질적인 자유와 평등‧노동민주주의‧민주복지국가 등임을 언급하고, 이러한 경제민주주의의 전략‧과제는 현행헌법 제119조를 위시한 경제헌법조항을 통해서도 도출될 수 있다는 것을 최대한 옹호하였다. 본 논문의 3장에서는 이러한 경제민주주의에 대한 분석의 틀 거리를 가지고, 헌법의 최종적‧권위적 해석기관인 헌법재판소의 경제헌법 판례 26건을 추출하여 비판적으로 분석해보았다. 판례분석결과 경제민주주의에 대한 헌법재판소의 이해는 원리‧원칙‧선언과 같은 추상적 수준에서 경제민주주의의 이론적 표지에 수렴하는 진보적 헌법해석을 시도하지만, 구체적인 입법‧정책‧제도와 연계되는 사항에서는 진보적 헌법해석을 희석시켜 보수주의로 회귀하는 경향이 나타남을 알 수 있었다.
Abstract
In this study, economic democracy is noted as the basic principles in our constitutional system. This study examines the ideological characteristics of economic democracy and analyzes how it is reflected in the current Korean constitution. It also looks at the economic constitutional case laws that are embodied in the Korean constitution. Chapter two of this paper examines the theoretical features of the economical democracy. The social market economy, administered capitalism, positive liberty-equality, labor democracy, democratic welfare state, and etc. are all part of the economic democracy. This paper also advocates that the ideological element of this economic democracy can be derived through the economic constitutional provisions that are included in the article 119 of the Korean constitution. Chapter three shows the framework analysis of the economic democracy mentioned above and 26 cases of the economic constitutional case laws of the Korean constitutional court. The progressive constitutional interpretation with the principles, fundamentals, and abstract levels, which converges in the ideological characteristics of economic democracy, is shown through the analysis of the constitutional court case laws. However, progressive constitutional interpretation tends to revert back to conservatism when specific matters are related to legislation, policies, and etc.
