Compulsory Wreck Removal: Administrative Regulation and Civil Liabilities under Chinese Law

In China, as more and more environmental problems have been reported in recent years, the demands of authorities have grown and may influence the entire approach to a wreck removal operation, resulting more wreck removals required on the basis of environmental consideration. On the other hand, the trend of more market-oriented economy has entailed step by step de-regulation of authorities on activities of wreck removal. Under such circumstances, this paper tries to clarify relevant typical administrative and civil issues in relation to compulsory wreck removal and comment on the controversial provisions in current Chinese regulation.
Abstract
