부모의 민사책임에 관한 비교법적 고찰

초록

미성년자의 불법행위에 대한 친권자의 책임에 대한 구체적인 입법론이나 해석론은 그 나 라의 법체계 및 법문화 등에 따라 다르게 나타날 수밖에 없다. 다만 근래 들어 피해자의 구제 뿐 아니라 급증하는 소년범죄의 문제로 부모의 책임을 강화해야 한다는 주장이 설득력을 얻 고 있으며, 이러한 동향은 대륙법계 국가든 영미법계 국가든 공통적으로 과실책임의 원칙을 중시하는 기존의 전통적인 의식의 변화로 나타나고 있다 . 그런데 우리와 유사한 입법례를 갖고 있는 일본에서 2015년 최근 그동안 무과실책임처럼 운영되어 온 부모의 책임에 대해 이를 정면으로 부정하는 최고재판소의 판결이 나와 법적으 로 사회적으로 큰 반향을 일으키고 있다. 이 사안에서 최고재판소는 부모의 책임은 자기고유 의 과실에 기인한 과실책임임을 밝힌 후, 미성년자의 불법행위에 대해 부모에게 사고에 대한 예견가능성이 없으면 부모는 책임을 지지 않는다고 판시하였다. 과연 부모는 책임능력 있는 미성년자인 자녀에 대해 어디까지 감독해야 하는가? 또, 자녀의 불법행위에 대해 어느 정도 까지 예견하거나 예견해야만 하는가? 한편, 미국의 경우 우리와 법체계는 상이하나 우리보다 개인주의적 사상이 훨씬 강함에도 불구하고 현재 모든 주에서 부모의 책임을 인정하는 것을 원칙으로 하는 내용의 제정법이마련되어 있다. 아이러니하게도, 이러한 해석론적 혹은 입법론적 상황은 개인주의적 법문화 의 성향이 강한 미국과 상대적으로 자녀의 교육의무에 대한 부모의 역할이 강조되는 일본이 마치 뒤바뀐 것처럼 보인다. 이에 이 논문은 책임능력 있는 미성년자에 대한 부모의 손해배상책임을 중심으로, 우리나 라의 논의 및 관련 판례를 살펴보고, 대륙법계 국가 중 일본을 중심으로, 영미법계 국가 중 미국을 중심을 각각 관련 논의 및 입법례, 판결례를 살펴본 후, 이들 국가가 우리나라에 주는 시사점을 정리한다.

Abstract

Recently, the liability of a supervisor for illegal acts committed by a minor has become a cliché-ridden subject, especially when the supervisor also has parental authority. For the fair allocation of damages, the prevailing opinion is that the rules for parental liability should be tightened, to prioritize consideration of the victim, rather than of the person with parental authority, whom could be classified as an offender in terms of the Tort Law. However, there was a judgment passed by the Supreme Court of Japan that presumably went against the international convention. Although the case was a matter of parental liability for a minor with diminished responsibility, the Supreme Court of Japan concluded that the person with parental authority could not foresee such incidents; therefore, it could not be implied that the person had neglected the duty of supervision. Following this conclusion, the Supreme Court of Japan ruled that there is no liability for the person with parental authority to compensate for damages. The judgment of the Japanese Supreme Court was interpreted to expand the possibilities for indemnification from parental liability for a minor who has the capacity for assuming responsibility, specifically by clarifying that parental liability is one’s own responsibility of negligence, regardless of whether the minor has or does not have the capacity of assuming responsibility. What is the expected extent for parents to supervise a minor with the capacity for assuming responsibility? The reasons attributable to parental liability are closely related to its legal characteristics, and the extent of the liability depends on whether their child has the capacity for assuming responsibility. In comparison, there are diverse examples of legislation and judicial decisions coexisting in terms of parental liability. For example, judicial decisions in countries following the Continental Law, such as Germany, France, and Japan, are made by the methodology expanding parental liability. Meanwhile, in other countries, such as the Netherlands and Belgium, legislations are made by the methodology judging the minor’s capacity for assuming responsibility by the age of the minor, and requiring evidences for the practicability of parental liability, or for its indemnification and limitation. On the other hand, as examples of legislation in the countries following the Common Law, the United Kingdom has been relatively faithful in maintaining the principles of traditional Common Law, which theoretically denies parental liability, while the United States has already acknowledged parental liability for a minor and added limitations to liability. In South Korea, the Civil Law has been revised three times in 1995, 2004, and 2012. We would like to examine the institution of the parental liability system, based on the revised Korean Civil Law and on the examples of Japan and the U.S.A., since Japan is the country that is most similar to South Korea among the countries following the Continental Law, and among the countries following the Common Law, the U.S.A. has established the Parental Liability Law in all of the states.
