지역균형발전 구조에 관한 헌법적 검토

본고에서는 지방자치의 본질과 헌법적 보장의 성격 등에 대한 기본적 검토와 지방자치와 관련된 헌법상 기본원리 등에 대한 분석 결과를 토대로, 수도권 중심으로 지나치게 심화되어 있는 지역불균형 현상을 완화하고 각 지역의 특성과 다양성을 살려 국가 전체적으로 균형발전을 실현할 수 있는 헌법적 과제에 대해 살펴보았다. 이러한 문제점을 극복하는 과정은 기본권을 최대한 보장하기 위한 통치시스템의 일부로서 지방자치를 이해하는 데에서부터 시작되어야 할 것이다. 즉, 지방자치는 기본권의 최대한 보장이라는 헌법의 최고이념과 목적을 달성하기 위한 수단으로서 작동되어야 한다는 ‘입헌적 지방자치’로 이해되어야 할 것이다. 이렇게 보게 되면, 국가보다 자치단체가 보다 근거리에서 지역주민들의 기본권을 신속하고 적절하게 실현시켜 줄 수 있을 것이다. 나아가 지역 간 사회적․경제적․문화적 격차가 심화되고 있는 헌법현실 속에서, 인간다운 생활을 할 수 있는 일정한 수준의 사회․경제․문화적 시설과 제도가 모든 지역에 균형적으로 갖춰져 있어야 한다는 차원에서 지역균형발전의 시대적 과제가 헌법적 요청임을 인식하고, 이를 위한 실천과제로서 지방세 등 자주세원의 확대나 수평적 재정조정제도의 강화 방안에 대해 살펴보고, 이를 위한 헌법적 토대를 마련하는 입법론적 방안까지 검토해 보았다.
Abstract
This study addresses constitutional issues on local government system in Korea, focusing on the task of Korean consitutional guarantee of the self-governing financial power for solidifying the foundation of balanced regional development which is one of the most important conceptual elements on the local government system along with decentralization, on the basis of reviewing the nature and essentials of local government system and analyzing relationship between local government system and constitutional principles, such as democracy, separation of powers, rule of law, principles of social states. Although the policy of balanced regional development has a certain degree ambiguous aspects, it will assuredly contribute to materialization of principles of social states through equally improving residents’quality of life all over the country. In this respect, balanced development of regions is one of the most significant constitutional values which shows features of local government system as a ruling system for guaranteing basic human rights of the people as much as possible.
