녹색인증제의 선진화를 위한 법ㆍ정책적 과제

2015년 12월 COP21에서 교토의정서를 대체하는 새로운 기후체제 출범을 합의함에 따라, 온실가스 감축 기술 개발 및 상용화가 완료된 관련 기술의 도입을 유도하는 한편, 신기술 및 설비 투자를 활성화하는 등 녹색기술 혁신을 위한 정책 마련이 필요한 상황이다. 우리나라는 2010년 1월 「저탄소 녹색성장기본법」을 제정하고, 녹색기술 인증, 녹색제품 확인, 녹색사업 인증, 녹색전문기업 확인을 내용으로 하는 녹색인증제를 도입하였다. 그러나, 최근 신청기업 및 인증기업의 수가 감소세를 보이는 등 제도 자체가 유명무실해지고 있다는 지적이 계속되면서, 관련 문제점을 검토하고 보완 방안을 모색할 필요가 있다. 본 논문에서는 녹색기술의 혁신을 위한 수단들을 살펴보고, 녹색인증과 국내ㆍ외 유사 인증을 비교ㆍ검토하여 법ㆍ제도적 개선 방안을 제시하였다. 먼저, 녹색인증제 운영요령에서의 인증대상 녹색기술 분류는 녹색기술 분류체계 및 타 기술 분류체계와의 비교 검토를 통해 녹색기술 전 분야를 포괄하면서, 다른 기술 분류와도 연계될 수 있도록 조정되어야 한다. 인증의 평가기관이 복수이므로 평가기관 간 기준 및 절차를 통일하고, 취득률 편차를 최소화 하여야 하며, 다른 제품에 녹색인증 표시를 부착하여 유통시키는 경우, 유효기간이 도과되었음에도 불구하고 녹색인증 표시를 사용하는 경우 시정명령을 하거나 인증을 취소할 수 있는 근거를 마련하여야 한다. 마지막으로, 녹색기술 및 녹색산업의 혁신은 민간 투자 및 시장 수요 확대가 전제되어야만 가능하므로, 그린카드의 적립 대상에 녹색기술인증제품을 포함함은 물론 포인트 제공 구매처 및 제조사를 지속적으로 확대하는 등 민간 부문의 수요 견인을 위한 방안도 모색하여야 한다.
Abstract
Since the international community agreed to the new climate regime to replace the Kyoto Protocol in COP21, We must develop technologies to reduce greenhouse gases. Korea has enacted Framework Act on Low Carbon, Green Growth in 2010, and green certification including green technology, green technology product, green project, specialized green enterprise was introduced in March, 2010. Recently, the number of applicants and certified companies has been decreasing, we need to look at the issues in the round. This paper examines the means for innovation in green technology, and proposes an improvement through compared with other certifications. Firstly, the green technology classification should cover the all of the green technology, and be linked to other technology classification systems. Secondly, the standards and procedures need to be unified because there are many evaluation organizations. Finally, as green technology innovation can be achieved through the expansion of market demand and private investment, so green technology products should be included in the scope of application of Green Card and be expanded stores and manufacturers.
