미국헌법상 개정금지조항에 관한 연구

초록
우리나라의 현행 헌법에는 명문의 개정금지조항이 존재하지 않지만, 몇몇 국가의 헌법에서는 개정금지조항의 사례를 어렵지 않게 발견되고 있다. 만약 우리 헌법에도 이러한 개정금지조항이 규정되어 있다면, 개정금지 대상조항의 개정 가능성뿐만 아니라, 개정금지조항 자체의 개정 가능성 등도 검토되어야 할 것이다. 이에 대한 우리나라의 통설적 견해는 개정금지조항에 의해 개정이 금지되고 있는 개정금지 사항은 그 성격 여하를 불문하고 개정될 수 없다고 보고 있는데, 과거세대에 의한 개정금지의 결정이 미래세대의 주권과 선택권을 박탈하는 결과를 초래할 수 있다는 점이 문제될 수 있다. 본고에서는 이러한 문제인식을 바탕으로, 노예수입 및 직접세 개정금지조항과 상원균등투표권 개정금지조항(연방헌법 제5조), 종교심사금지조항(연방헌법 제6조 제3항) 등 미연방헌법상 개정금지조항의 의미와 유형을 개관하고, 개정금지조항의 구체적 내용을 개별조항별로 검토함으로써 개정금지조항의 규범적 효력에 대한 시론적 논의를 전개하였는바, 헌법개정의 내재적 한계에 해당하는 헌법사항에 대한 개정금지가 아닌 경우에는 미래세대의 주권과 선택권을 존중해 주어야 필요가 있으므로 이에 대한 개정은 허용될 필요가 있다고 보았다.
Abstract
In this paper, I probe some issues on entrenchment provisions, which are not actually changed by any type of constitutional amendment, in the U.S. Constitution. There are two provisions in the U.S. Constitution that literally did prohibit amendment. One of both is the Article V declaration that “no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article.” The other is the Article Ⅵ provision that “no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.” In part Ⅱ of this paper, I will overview the meaning and the theoretical foundations of entrenchment provision, and analysis types of entrenchment provisions. And then, part Ⅲ will review the history, intention and contents in detail of particular entrenchment clause respectively. As a result, this introductory study newly raised, as a next project that should be undertaken, the most critical issue of whether the constitutional entrenchment could be justified against the argument that entrenchment clauses could undermine the participatory values of democracy.
