분쟁조정제도에 관한 법제정비 방안

Alternative Dispute Resolution(hereafter called ADR) provides rapid settlement, low cost and right protection means accessible to anyone compared to trials, so it is good for not only more effective dispute settlement but also alleviation of court's case burden ultimately. There are problems of extrajudicial dispute mediation system such as infringement of the constitutional right of access to courts and effectiveness of dispute mediation system, but forms and aspects of conflicts in this high tech society become very diverse, so the existing conflict settlement means like lawsuit can't protect constitutional basic rights enough. There are high demands for dispute settlement by extrajudicial dispute resolution process, or dispute resolution system. Due to the demands, extrajudicial dispute resolution process should be researched, categories and problems of 60 current dispute mediation systems are considered, and through legal reviews, dispute mediation systems should be the ones that can improve rapid and effective settlement for infringement of rights of those involved. In addition, current dispute mediation systems should be operated within the maximum range that laws permit for protection of rights of those involved.
