초록
우리는 일상생활에서 정신적･심리적 위험이 다가오면, 스스로 해결할 수도 있겠지만, 스스로 해결하기 어렵다면 전문가와의 상담을 통해 그 위험을 극복해야 한다. 복잡한 현대인들에게는 많은 스트레스로 인하여 상담의 도움을 필요로 하는 경우가 많은데, 따라서 개인에서 사회･국가에 이르기까지 모든 영역에서 상담은 더욱더 강조되고 있는 실정이고, 이에 우리나라의 여러 법률에서 ‘상담’과 ‘상담사의 법적의무’에 관하여 규정하고 있다. 그런데 상담은 상호 협력적 과정이므로 상담과정은 내담자뿐만 아니라 상담자에게도 영향을 미친다. 즉, 상담자도 상담과정에서 많은 고충을 겪게 되고 여러 가지 상황에서 기본권을 침해받고 있다. 그럼에도 불구하고, 상담사는 그 법적 의무를 다해내고 있다. 법은 권리와 의무를 규정한 것이다. 그런데 현행 법률에서 상담사의 법적의무는 규정하면서도 상담사의 권리에 관하여 명시한 규정은 없다. 따라서 이제는 상담사의 기본권 보장을 위해서라도 상담사법은 제정되어져야 한다. 이에 본 연구에서는 우리나라 ‘상담사 등의 처우 및 지위 향상을 위한 법률(약칭; 상담사법)’의 구체적인 법률안을 제시하였다.
Abstract
When a mental or psychological risk occur in our daily lives, we have a choice of handling it on our own or seeking for a professional help from a trained counselor to overcome the risk. In this modern world where problems are more complex, there is a growing need for counselling services as more and more people are suffreing from stress related problems. This rising demand for counseling places more emphasis on counseling in all areas from individuals to society and the nation. In this regard there are several laws to regulate ‘counseling’ and ‘legal obligation of counselors’ in South Korea. Counseling requires a mutual cooperation that affects both clients and counselors. Often times counselors encounter difficulties in counselling and there are many cases where their basic rights get violated, While counselors are committed to meet their legal obligations defined by law there is no provision in regards to the rights of counselors. In this respect, this paper suggests the need for enactment of counselors law to guarantee the fundamental rights of counselors.
