초록
최근 일부 의료기관에서 일회용 주사기를 재사용하여 C형 간염바이러스가 집단으로 감염된 사례가 연달아 발생함으로써 사회에 커다란 파장을 일으켰다. 더구나 저렴한 가격의일회용 주사기를 재사용하는 것은 C형 간염 감염증 외에도 다양한 중증 질환의 감염원인이 될 수 있다는 것은 의학적 지식을 넘어서 주지의 사실이다. 그럼에도 불구하고, 중대한위험성을 누구보다 잘 알고 있는 의료인에 의하여, 주사기 재사용으로 인한 집단 감염이발생하였다는 것은 심각한 문제이다. 그러므로 의료인의 주사기 재사용 등으로 인해 발생한 집단감염 사태에 대하여 현행법상 어떠한 법적 책임을 추궁할 수 있는지와 그 책임의 정도는 어떠하여야 하는지에 관하여살펴볼 필요가 있다. 본고에서는 ① 주사기를 사용한 주사시의 의료과실의 유형을 살펴보고, ② 과실로 주사기 감염을 발생시킨 의료사고에 대한 현행법상 책임의 범위가 어떠한지 검토한 후, ③ 외국의 사례에서 어떠한 문제점이 논의되었는지를 비교한 뒤, ④ 주사기 감염에 관한 책임에관한 특수성과 그 법적용에 관하여 고찰하고자 한다.
Abstract
Recently, the use of disposable syringes in some hospitals led to a series of cases of hepatitis C virus infection and these cases caused a huge wave of society. Furthermore, it is well known that reusing low-cost disposable syringes can cause infections of various serious diseases other than hepatitis C infection. Nonetheless, it is a serious problem that a group infections caused by reuse of syringes by a medical practitioner who knows medical risks. Therefore, it is necessary to study what kind of legal liability can be pursued and what degree of responsibility should be imposed on the current infectious disease caused by reuse of syringes by medical personnel. In this article, we research the types of medical malpractices at the time of injection using a syringe and (2) the extent of liability under current law for medical accidents that caused infections with syringes. (3) After comparing the problems discussed in foreign cases, (4) we study on the specificity of the responsibility for syringe infections and their legal use.
