카프카 문학속의 범죄와 형벌

This article mainly examines the criminal images which lie in the novels of the Kafka who has been known as one of the most famous existentialist as writer in 20th centuries. Due to the difficulty to understand his works, expressions that he used in the novels do not match exactly with the technical terms as criminal studies and it is such a hard work to find out the real concepts, because there are a lot of deep and mysterious meanings behind the expressions in his writings. But because his life was not separated from his profession and his expressions were stemmed from his daily professional legal works, we could trace the meaning of the words that he used in the novels from the viewpoint of the legal proposition. We believe this endeavor does not disparage his works as the literature, but it could enhance and expand the realm of the his novels’ values as masterpiece. This kind of research could build the bridge between literature and legal studies and narrow the gap of the big chasm. In the near future, more legal scholars would be required to study about the legal understanding of the ancient and modern novel writers who have written stories, using the legal terms and terminology. It could bring more deep understanding about the novels themselves and also give more ideas to understand law itself. Lawyers who try to grasp the legal system only through the eyes of the logic and theory would experience the limits of legalism, so be obliged to feel the needs of ‘Poetic Justice’. Efforts to connect between Law and Literature studies could be lasted by the interdisciplinary works to the next generations in the legal studies.
