형사재판에 있어서 녹음된 진술의 증거능력

초록

녹음테이프나 녹음파일의 증거능력을 논의함에 있어서는 그 매체에 녹음된 진술을 진술녹음과 현장녹음으로 나누어 검토하는 것이 반드시 필요한 것은 아니지만, 적어도 그 구별이 이 문제에 대한 설명과 이해의 편의를 도모함에 있어서 도움이 될 수 있다. 진술녹음은 사람의 진술이 녹음되어 있고 그 녹음파일에 담긴 진술 내용의 진실성이 증명의 대상이 되는 것이고, 현장녹음은 범죄현장에서 발생되는 사람의 발언이나 음향을 녹음한 것으로 그러한 말이나 소리의 존재가 있었다는 사실 그 자체가 증명의 대상이 되는 것을 말한다. 대법원은 진술녹음이나 현장녹음이라는 용어를 사용하지 않고 있으나 녹음된 진술의 증거능력의 판단에 있어서는 위와 같은 기준에 따라 판단한다. 진술녹음의 증거능력은 녹음자가 누구인가에 따라 형사소송법 제311조 내지 313조를 적용하는 것이 타당하지만, 수사기관이 수사과정에서 피의자나 참고인의 진술을 녹음한 이른바, 영상녹화물의 경우에는 형사소송법 제312조의 요건을 갖춘 경우에도 독자적인 증거능력을 부여할 수 없다고 보는 것이 현행 형사소송법의 체계와도 부합된다. 그리고 현장녹음은 비진술증거이지만, 녹음과정에서 조작 등의 위험이 게재될 여지가 있으므로 검증조서의 증거능력에 관한 형사소송법 제312조 제6항에 따라 적법한 절차와 방식에 따라 녹음되고, 녹음자의 진술에 의하여 성립의 진정이 증명되어야 증거능력이 인정된다. 대상판결1은 녹음된 피고인의 내란 선동에 관한 진술 내용은 전문증거가 아니라고 보아 작성자의 진정성립 부정에도 불구하고 증거능력을 인정하였다. 반면에 대상판결2와 대상판결3은 녹음된 대화 내용 중 피고인의 협박성 발언이나 수뢰와 관련된 발언의 내용은 실질적으로 ‘피고인의 진술을 기재한 서류’와 다름이 없다고 판단하고, 녹음된 진술 내용을 증거로 사용하기 위해서는 형사소송법 제313조 제1항에 따라 녹음자의 진술에 의하여 녹음된 피고인의 진술 내용이 그가 진술한 대로 녹음된 것임이 증명되고 나아가 그 진술이 특히 신빙할 수 있는 상태하에서 행하여진 것임이 인정되어야 하는데, 위 두개의 대상판결은 모두 작성자의 진정성립이 증명되고 특신상태 또한 인정되므로 증거로 사용할 수 있다고 판단하였다 대상판결2와 대상판결3과는 달리 대상판결1은 피고인이 이 진술부분의 진정성립을 부인하고 있어서, 이 부분을 전문증거로 파악하는 경우 그 증거능력을 인정할 수 없게 되어 피고인에 대하여 무죄를 선고하여야 할 지도 모르는 상황이었으므로 대상판결1에서의 이 부분의 쟁점은 특히 중요한 의미를 가지고 있었다고 할 수 있다. 그러나 현행 형사소송법은 제313조 제2항을 신설하여 피고인이 진정성립을 부정하는 경우에도 과학적 분석결과에 기초한 디지털포렌식 자료, 감정 등 객관적 방법으로 그 진정성립이 증명되면 그 진술의 증거능력을 인정하고 있으므로 이 진술녹음을 전문증거로 파악하더라도 유죄증거로 사용할 수 있다는 결론에는 변화가 없을 수도 있을 것이다. . 대상판결1에서 대법원은 이 녹음내용이 그러한 내란 선동에 관한 진술이 있었는지 여부 등 그 진술 내용의 진실성과는 무관한 간접사실들을 증명하기 위하여 제출되었으므로 전문증거가 아니라고 판단하였는데, 그 논증은 타당하다. 그리고 설혹 위 녹음내용이 요증사실을 증명하기 위하여 제출된 것이라고 보더라도 그 발언은 발언자 자신의 내란 의지와 의식을 표명하는 것이지, 그들의 외부로부터의 경험의 전달이라고 할 수는 없기 때문에 경험과정에서의 인식(지각), 기억, 표현의 오류 여지는 없어서 이를 전문증거라고 할 수 없다. 따라서 작성자에 의한 진정성립이 증명되지 않았음에도 불구하고 이 녹음내용의 증거능력을 인정한 대법원의 판단은 결론적으로 타당하다. 그러나 대상판결2에서의 피고인의 협박 발언은 그의 경험의 전달이 아니라 자신의 생각이나 의지의 표현이어서 그 존재 자체만으로 피고인의 협박 사실을 증명할 수 있고, 대상판결3에서의 돈을 받았음을 추정할 수 있는 듯한 피고인의 발언은 수뢰사실을 직접 증명하지는 못하지만 그 발언의 존재 자체가 수뢰사실에 대한 간접적 정황증거가 되기에는 충분하다. 따라서 이 두 판결에서의 피고인의 발언 모두 대상판결1과 같이 전문증거라고 할 수는 없다. 그러나 대법원은 대상판결2와 대상판결3에서 녹음 내용을 전문증거로 파악하고 있어 부당하다고 하지 않을 수 없다. 설혹, 대상판결2와 대상판결3의 녹음 내용을 전문증거라고 하더라도 원진술자인 피고인의 진정성립 없이 녹음자의 진정성립만으로 그 증거능력을 인정한 대법원의 판단은 타당하다고 할 수 없다.

Abstract

In discussing admissibility regarding a recording tape or a recorded file, it is not necessary to distinguish a statement recording from an on-site recording but the distinction, to some degree, helps to explain and understand this issue. The statement recording refers to a person’s statement account of a past event and the statement’s authenticity shall be proved under the law of evidence. On-site recording means a recording of one’s talk or sound at a crime scene and the fact that this talk or sound existed, per se, shall be proved. The Supreme Court does not use the terms of statement recording or on-site recording but decides admissibility regarding the recorded statements according to the above-mentioned criteria. In case of a statement recording, it is reasonable to decide its admissibility according to a recording person in consideration of the Articles 311~313 of the Criminal Procedure Act. However, it is consistent under the criminal procedural system to deny independent admissibility about video recordings in which investigation agencies record the statements of suspects or witnesses during the investigation even if the video recordings are satisfied with the requirements under the Article 312 of the Act. On-site recordings are evidence of non-testimony. Because on-site recordings can be easily manipulated, they should be admissible only when they are recorded according to the legitimate procedures and methods under the Article 312, Paragraph 6 of the Act and their authentication is proved by the statement of recording persons. The Supreme Court determined at 2014DO10978 (Judgment 1) that the recorded statement of the defendant’s incitement to insurrection is not hearsay evidence, and admitted the evidence in spite of its authentication. However, the Court considered at 2012DO7461 (Judgment 2) and 2007DO10804 (Judgment 3) that defendants’ intimidating remarks or mentions regarding bribery are same as “the documents describing the defendants’ statements.” Furthermore, the Court pointed out that the authentication of on-site recordings shall be proved by the statements of the recording persons in accordance with the Article 313, Paragraph 1 of the Act in order to use the recorded remarks as evidence and that the defendants’ remarks shall be made under the particularly reliable circumstances. Therefore, the Court admitted evidence with regard to the recordings of Judgements 2 and 3. The Court’s judgement 1 seems to be reasonable. In the case, the Court ruled that the recording does not fall under hearsay evidence in that it was submitted as circumstantial evidence irrelevant to the statement’s authenticity, for example, whether the recording contains the defendant’s incitement to insurrection and this judgement seems to be reasonable. Even if the recording was submitted in order to demonstrate the facts required to be proved, the defendant’s talks cannot be hearsay evidence on the grounds that the talks are not external delivery of experience but expression of his will and consciousness of insurrection and, accordingly, there is no room for error in perception, memory or expression during experience. Therefore, the judgment of the Supreme Court admitting evidence of this recording, despite the fact that the recording’s authentication is not proved by the recording person, is considered as valid. However, the defendant’s intimidating remarks in the judgement 2 are not a delivery of his experience, but rather an expression of his own thought or will and, thus, the remarks, by itself, can prove the fact about his intimidation. In the Judgement 3, the defendant’s remarks presuming acceptance of bribes cannot directly prove the fact about acceptance of bribes but are sufficient to be circumstantial evidence with regard to the fact about acceptance of bribes. Therefore, the defendants’ remarks in these two cases, unlike the remarks in the judgement 1, cannot be considered as hearsay evidence. However, the Court’s judgements 2 and 3 are not reasonable in that the recordings concerned are determined as hearsay evidence. Even if the recordings of Judgments 2 and 3 are regarded as hearsay evidence, the judgements are not valid on the ground that there are authentication of the recording persons without defendants’ authentication.
