미국 영화산업의 특허권 분쟁과 독점: 영화특허회사의 설립을 중심으로

초록
19세기 말부터 20세기 초반 미국의 산업은 급격히 발전하였고, 또한 많은 특허권 분쟁이 발생하였다. 19세기 말 등장한 미국의 영화산업 또한 여러 특허권 분쟁이 발생하였고, 그 중심에는 1890년대 초 키네토스코프(Kinetoscope)와 키네토그래프(Kinetograph)를 발명한 토마스 에디슨(Thomas A. Edison)이 있었다. 1897년 8월 키네토스코프의 특허가 승인되자, 에디슨은 북미 전역의 영화산업에 대한 동영상 제작에 필요한 필름과 기술을 통제·장악하기 위해, 미국에서 운영되는 모든 주요 경쟁자들에 대한 특허침해소송을 제기하였다. 이후 1908년에서 1909년 사이 설립된 특허출자연합, “영화특허회사(Motion Picture Patents Company)”가 에디슨제작사를 중심으로 설립되면서 에디슨의 특허침해소송은 막을 내렸다. 본 논문은 초기 영화산업이 성장하는 데 있어 중요한 역할을 수행하였던 에디슨의 특허권 분쟁 과정을 살펴보고, 이 특허권 분쟁이 이후 미국의 영화산업에 어떠한 영향을 주었는지를 살펴보고자 한다.
Abstract
The American industry developed between late 19th century and early 20th century and happened a lot of patent disputes in this time. The American film industry that began late 19th century also happened a number of patent disputes and Thomas A, Edison who invented the Kinetograph(moving picture camera) and the Kinetoscope(motion picture exhibition device) was at the center of this patent disputes. Edison brought patent suits against all of leading competition for controlled and held films and technologies of moving pictures making in the American film industry when the Kinetoscope was issued on 1897. And this patent suits closed between 1907 and 1908 when formed a patent pool, the Motion Picture Patents Company that established by the Edison manufacturing company and other companies which had some patents. The purpose of this study is to examine the process of Edison’s patent disputes that made an important role in the early film industry and then take a look at how this patent disputes had an impact on the American film industry.
