로스쿨 교육방법 개선에 관한 단상(斷想)

The aim of the newly implemented law school system in Korea is to nurture lawyers through legal education, not to elect them through a harsh examination. Given this aim, the change that the law school system purports to pursue should begin in the classroom. This makes the improvement of law school teaching a core topic to be addressed in the discourse concerning a law school system. However, the discourse that has taken place up to now in Korea has been rather political than practical. Relatively small portion of the discourse has been on the improvement of law school teaching, while fierce debate on the justification of the system itself along with the attempt to resurrect the old regime has swallowed up the whole nation for considerable period. This article intends to address the improvement of law school teaching, especially focusing on three sub-topics; improving lecture, facilitating student participation, and rethinking evaluation method. This article not only makes theoretical and abstract suggestions, but also presents in-field experiences and observation as well as feedbacks from law school students. This article also deals with the implication and direction of student participation in the current law school setting where heavy pressure to learn vast amount of legal knowledge in a relatively short period. Finally, this article points out that current level of discussion on the improvement of law school teaching is unsatisfactory. It further suggests that the nationwide organization that exclusively focuses on this issue be established, and also suggests some feasible measures that respective law school can employ immediately.
