현행 벌금형제도의 문제점과 개선방안 - 일수벌금형제도 도입을 중심으로 -

초록
우리나라의 경우 벌금형제도가 일정액의 벌금을 총액으로만 표시하여 선고하는 총액벌금형제도를 취하고 있어, 벌금형을 부과・산정하는 과정에서 피고인의 경제적 상황 내지 사정을 고려하지 않는다는 것이 현행 벌금형제도의 근본적인 한계이자 문제점으로 지적되고 있다. 이러한 총액벌금제의 한계와 문제점으로 인해 그 대안으로서 거론되고 있는 것이 일수벌금형제도이다. 일수벌금형제도는 총액벌금형제도가 안고 있는 한계와 문제점을 보완하여 자유형과의 균형을 고려하여 사회적으로 정당한 벌금형을 도출해내기 위해서 개인의 자산정도를 고려하여 벌금액을 부과하는 산정방식으로 프랑스, 독일, 스웨덴, 스위스, 오스트리아 등에서 도입하여 시행하고 있는 제도이다. 최근 우리나라도 유럽 다른 국가들처럼 소득에 따라 차별을 두는 일수벌금제도를 도입하자는 주장이 법조계와 학계 및 시민단체 등에서 강하게 제기되고 있고, 국회에서는 입법 논의도 활발하게 이루어지고 있다. 본논문에서는 현행 총액벌금형제도의 현황과 문제점을 살펴보고 외국의 입법례를 바탕으로 일수벌금형제도 도입을 통한 현행 벌금형의 개선방안을 살펴보았다.
Abstract
The use of monetary penalty as an alternative of short-term confinement has increased because it is less costly, minimizes the nagative effects of imprisonment, and makes possible to those fined easy to reintegrate to the society, while fulfilling the retributive and general deterrence purposes. A fine is the most available means of punishment nowadays. But The current fine systemz(total amount of fine system) cannot stisfy the principle of equal sacrifice because the defendant with less economic means and ability would feel it the more painful. Thus, the current total amount fine system has some problems. Day fine system was designed to solve the problem, by considering net income and other economic conditions of each defendant in valuing the fine. Therefore, We need to consider and decide the range of application of this fine system.
