공공보행통로의 법적 쟁점과 행정중심복합도시 사례 연구

초록
공공보행통로는 민간 대지 내 보행자통로로서 주로 지구단위계획으로 지정된다. 그런데 최근 들어 공공보행통로와 관련된 갈등이 사회적 이슈가 되고 있다. 이에 본 연구는 공공보행통로와 관련된 법적 쟁점과 실제 사례를 살펴보고 개선방안을 제안하는 것을 목적으로 한다. 공공보행통로와 관련된 법적 쟁점은 크게두 가지인데 첫째, 공공보행통로의 운영 및 관리를 위한 지원 제도가 부족하다. 둘째, 공공보행통로를 막거나 통행을 방해하는 행위에 대한 규제 장치가 미흡하다. 이를 위해서 국토의 계획 및 이용에 관한 법률의개정을 통해 지원 및 처벌에 대한 근거조항을 수립할 필요가 있다. 또한 최근 공공보행통로가 계획·실현된행정중심복합도시의 사례를 살펴본 결과 첫째, 불필요한 지정 등 과도한 계획, 둘째, 계획과는 다른 통로이용 행태, 셋째, 불법주차 및 통행방해 행위 등 관리운영 미흡과 같은 문제들이 발견되었다. 따라서 공공보행통로의 도입 취지를 구현하기 위해서는 지정 원칙을 구체화하여 꼭 필요한 곳에만 지정되도록 해야 하며, 지정현황과 관리운영방안 등 관련 정보를 공개하여 주민들의 이해와 협조를 높여야 한다.
Abstract
Through-block pedestrian links are planned pedestrian pathways in private properties, which in some cases cause civil conflicts. This paper explores the legal issues and real-world cases of the pedestrian links and draws out the alternative. Review on the legal provision for through-block pedestrian links revealed that planning resolutions for the pedestrian links do not include neither any supportive measures for operations and management, nor regulations against blocking or interference use of the pedestrian links. Hence, supplement legislations are needed involving the Planning Act to support management and ensure public use of the pedestrian links. Case studies focusing on the Administrative City shows several problems involving design and use of the pedestrian links. Firstly, some pedestrian links are designated without any specific planning purposes. Secondly, cases are found where pedestrian links are being used for non-public purposes. Thirdly, illegal parking and blocking activities were found on several links. These findings suggest that planning guidelines should be elaborated for designation of through-block pedestrian links in private properties in order to prevent designating pedestrian links without public purposes, and local government should ensure public access to the information including location and management of the pedestrian links.
