초록
ADR에 대한 관심이 높아가고 있다. 우리나라에서는 상대적으로 많은 분쟁이 발생하고, 우리 법에 영향을 준 구미제국이나 일본에서 논의되고 있는 각국의 ADR로부터 많은 영향을받고 있기 때문이다. 지금까지 우리나라에서 논의되고 있는 ADR에 관한 논의는 대부분 제도의 개략적 소개를 주된 대상으로 하고 있다. 그러나 보다 중요한 것은 실제로 외국에서새로 도입한 ADR이 어떻게 운영되고 그 결과 어떠한 성과를 내고 있는지 알지 못하면, 단순한 외국법제의 소개는 특별한 의미를 갖지 못하는 것이 될 것이다. 외국에서는 특정 분쟁에 대한 ADR을 도입하였고 그것을 시행하였더니 성과는 어떠하고, 그러한 성과가 나온 이유는 절차적으로나 제도적으로 어떠한 점에 기인한지를 알아야 한다. 이 연구는 손해보험분쟁과 ADR의 구체적인 사례로서 일본에서 금융ADR 도입 후 가장많은 사건을 처리하고 있는 손해보험협회 산하 손보ADR을 다루는 것이다. 이를 통해 우리나라에서의 손해보험분쟁의 처리를 위한 ADR의 운영, 나아가 새로운 ADR제도의 창설에 있어 적지 않은 시사점을 얻을 수 있다. 공정한 분쟁해결을 할 수 있게 되면, 그것이 국민 모두에게 인지됨으로써 권리구제에 도움이 되고, 손보회사에게도 적절한 분쟁해결을 통한 보험업무의 개선과 국민의 보험제도 이용증가에 기여할 것이다. 우리 손보협회도 손보회사는물론 이용자인 국민에게 도움이 되는 위와 같은 형태의 ADR기관에 주목하여야 할 시기가되었다고 생각한다. 또한 우리도 충분히 그러한 기관의 설립이 가능하다는 점은 누구도 부인할 수 없을 것이다.
Abstract
Recently, more individuals have an interest in ADR. This is because dispute over ADR happens relatively frequently in Korea and Western, Japanese ADR have great influence on Korean ADR(Law in western countries and Japan also affects Korean law, in itself). Discussion about ADR in Korea mostly focuses on a brief introduction of ADR system until now. However, introduction of foreign law would be meaningless if we do not know how newly adopted ADR is conducted and what kind of achievement ADR makes in foreign country. It is more important to understand what results from the enforcement of ADR for specific disputes. Moreover, it is meaningful to know which procedure or system produces this achievement. This study is about 'SONPO ADR' from The General Insurance Association of Japan, as a specific example of ADR over disputes related to insurance. 'SONPO ADR' has solved cases the most after finance ADR was introduced in Japan. The study will eventually suggest considerable implications about conducting ADR for solving disputes over insurance and establishing new ADR system in Korea. If these disputes are able to be settled fairly, it eventually helps to guard the individuals' rights. Furthermore, it would contribute to improvement of insurance business through proper solution over disputes in related insurance company. It is expected more people take advantage of insurance system. It is time for General Insurance Association of Korea to pay attention to aforementioned type of ADR system which would be helpful to both insurance companies and the people as users. No one can deny that we are available to establish those kinds of ADR institution well.
