장기요양기관 현지조사의 법률적 문제

The aging trend of Korean society is the fastest in the world. It is expected that the proportion of elderly population will exceed 40% in 2058 and enter into a super-aged society. As a result, the elderly 's dependency problem became a social problem, and the government introduced the social insurance system for the elderly's long-term care insurance in 2008. The National Health Insurance Corporation and the local government have guided and supervised the long-term care business. Illegitimate and invalid administrative measures at the time of field survey by those administrative agencies are increasing every year. The purpose of this study is to analyze the legal cases of Illegitimate and invalid administrative measures in the field survey of long-term care institutions for the elderly and to find out improvement direction. This research is necessary for the protection of the basic rights of long-term care institution operators, residential elderly people and their care givers under the social security system. The method of this study is to review literatures and analyze legal and empirical cases in empirical and legal point of view. Based on the results, the institutional improvements are suggested so that the guiding and supervision of administrative agencies are coincided with the purpose and intent of the law, the basic rights of institutions operators and elderly people living in long-term care institutions and obligations of administrative agencies.
