법관의 자기이해에 관한 경험적 연구

바람직한 법관을 논함에 있어 법관의 자기이해에 대한 탐구는 매우 중요하다. 왜냐하면 법관의 판단에서 법관의 인격이 개입될 수밖에 없기 때문이다. 그러나 우리에게는 법관 스스로 자신을 되돌아보면서 이상적인 법관상, 훌륭한 법관상을 그려보는 전통이 별로 없다. 이에 법관의 자기이해를 추적하기 위해 현직 법관 140명을 대상으로 설문조사를 실시하였다. 이 조사는 ① 법관의 중요한 역할에 대한 인식, ② 결정단계에서 겪는 어려움의 원인, ③ 확립된 판례 법리가 당해사건에서 부당한 결과를 가져온다고 생각될 때 결정 방향, ④ 직업만족도, ⑤ 시간에 대한 압박감, ⑥ 직업생활과 사생활 간의 연결/분리 정도, ⑦ 일과시간 이후 사건 처리에 개인시간을 할애하는 빈도, ⑧ 결정하기 어려운 사건의 결정단계에서의 심리적 부담, ⑨ 법학교육에서 강화되어야 할 영역, ⑩ 법관연수에서 강화되어야 할 부분에 대한 의견, ⑪ 법관 스스로 생각하는 이상적인 법관의 자질, ⑫ 판결하기 가장 어려웠던 사건, ⑬ 가장 보람을 느꼈던 사건, ⑭ 직업생활에서 부딪히는 가장 큰 어려움, ⑮ 법관의 직업병, ⑯ 동료 법관에게 추천하고 싶은 도서 등을 묻는 문항으로 구성되었다. 이 글에서는 각 문항별로 설문조사 결과를 분석하였다. 조사 결과를 종합하면, 법관들은 중립적인 분쟁해결을 위해 노력하지만 결정 단계에서 다양한 어려움을 경험하고 있는 것으로 나타났다. 또한 법관들은 이상적인 법관이 되기 위해서는 매우 다양한 덕목을 갖추어야 한다는 생각을 공유하고 있었다.
Abstract
In discussing what constitutes an ideal judge, it is very important to look to how judges understand themselves, particularly because judges’ personalities are bound to intervene in their judgments. However, in Korea judges do not tend to reflect on their career and portray ideal or desirable judges. To investigate judges’ self-understanding, we conducted a survey with 140 judges. This survey consisted of questions about various topics such as judges’ roles, difficulties in deciding cases, how to deal with a hard case, job satisfaction, time pressure, separation or integration of professional and personal life, working overtime, psychological burdens in deciding a hard case, ideal judges’ virtues, and experiences about the hardest case and the most rewarding case. The results showed that the judges tried to resolve disputes fairly, but experienced various difficulties in decision-making. Also, the judges shared the idea that various virtues were required to be an ideal judge.
