In modern society social rights are the right to a minimum of human life. Generally, social rights have been justified through citizenship, human rights, and distributive justice. We need to check that it can be a basis for social rights of migrants who have no nationality in a multicultural society. Social rights were traditionally based on citizenship. But in this case, there is a limit to exclude members who do not have citizenship. Justification of social rights by human rights has advantages in terms of universality, but power of rights are weak. According to distributive justice of Rawls, it is a more fair social system to apply the principle of equality in social rights. In the justification of the social rights of migrants citizenship and human rights may conflict and justification through the distributive justice is reduced to the question of the conflict between citizenship and human rights. In conclusion, the Argument that is commonly found in three perspectives is converged into how to recognize the identity of migrant. The generosity of the people to the identity of migrants is required. In practical terms we should accept migrants as members of our society through the generosity of their identity.
