This article has studied the organ of trade union including the concept and the type of organ of trade union in the labor law in Korea and other countries. The organ of trade union has performed various functions to have relations with labor. They include the function of decision making, the function of enforcing, the function of protecting laborers, the function of bargaining collectively with employer, and the function of strike, boycott, and picketing to improve the conditions of work. The Korean labor law provides these functions. The Korean court deals with the disputes relating to the interpretation of articles of the labor law about these functions. The disputes relating to the organ of trade union are very difficult. As the results, so many legal problems have come in the history of the labor law in Korea. Many people have interests about these legal problems. Articles of the labor law about the organ of trade union and the functions have very important meanings for administering trade union and improving the conditions of work. This article has tried to analyse many legal problems about the organ of trade union and the functions in the labor law. This article has the purpose to give perspectives about the organ of trade union and the functions in the labor law.
