인간존엄성에 기초한 건설근로자의 중대한 산업재해 현황 분석

Social polarization, low birth, aging phenomenon are the serious social problems in Korea. For solving them, appropriate and different measures are taken by government. The social polarization of them is an important element to impede the social cohesion and the social peace. It is always said that the cause of social polarization to employees is wage differentials. Thought the employees of low income class is the result of wage differentials, different measures should be also taken by government for realizing the human dignity. The safety of the employees’ body and life is a essential step in the course of labor. In other words, industrial accidents must be prevented. For it, the current state of industrial accident in construction workers must be realized and analysed. It is explained that the industrial safety and health law is based on the article 34 as well as the article 32 of constitutional law and the relations between the industrial safety and health law and the workers’ compensation law. Then, I showed that construction is the structure that is apt to generate the industrial accidents in comparison with the other type of business. So it is regarded as the one of the character in construction. Under the character in construction, the actual current state of industrial accident in construction workers was realized and analysed. In addition to them, the cases on the industrial accidents were set forth and analysed. I founded the policies of preventing the industrial accidents in construction on them. I've come to the conclusion that the consciousness of the employees and the employers is the most important for the prevention of industrial accidents.
