행정법상 변호사 등 자격 취득 후 그 등록의 법적 성격

초록
행정법상 ‘등록’은 전형적인 행정행위의 하나가 아니고, 그 법적 성격에 대해서 학자들 사이에 ‘수리를 요하는 신고’, ‘허가’, ‘공증’ 등 다양하게 평가되고 있다. 이렇듯 모호한 등록의 법적 성격을 규명하기 위해서는 개별 실정법을 검토할 필요가 있다. 이 논문은 여러 가지 등록제 중 자격과 관련된 등록을 검토하고자 하였고, 감정평가사, 건축사, 공인노무사, 공인중개사, 공인회계사, 변리사, 변호사, 세무사, 의사, 행정사의 10개 자격 취득 후 행하는 등록의 법적성격을 살펴보았다. 이들 자격의 취득은 전부 시험합격을 통해 이루어지고, 등록은 자격취득과 무관하다는 점을 알 수 있었다. 자격을 취득하였다고 해서 바로 업무를 개시할 수 있는 것이 아니고, 별도로 등록이나 업무신고가 있어야한다. 이 부분에서 등록이 작동한다. 감정평가사, 건축사, 공인노무사, 공인중개사, 공인회계사, 변리사, 변호사, 세무사의 경우 ‘등록’이 업무개시요건이고, 등록의 거부사유를 보면 실체적 요건에 대한 실질적 심사가 이루어야 져야 한다는 것을 확인할 수 있다. 또 감정평가사․건축사․공인노무사․공인회계사․세무사의 자격 등록과 공인중개사의 사무소개설등록은 완화된 허가제로서의수리를 요하는 신고로서 기속적인 행위로 평가할 수 있고, 변리사, 변호사의 자격 등록은 재량의 여지가 있는 허가로 평가할 수 있고, 의사 등록은 사실행위로 평가될 수 있다는 결론에 이르렀다.
Abstract
In administrative law, the ‘registration’ is not one of the typical administrative acts. And there are a lot of opinions about the legal meaning of the legistration. In order to examine closely the legal meaning of the registration, I think that it is needed to investigate the positive laws individually. So, in this paper, I investigate the legal meanining of the registration about 10 qualifications such as attorney-at-law and so on. As a result, I think that the registration of certified public appraiser, architect, certified labor consultant, certified public accountant, tax accountant, and the office registration of licensed real estate agent means ‘report needed for acceptance’. And I think that the registration of patent attorney and attorney-at-law means ‘permit’. And I think that the registration of doctor is not a legal act, but a fact.
