지방분권법상의 지방자치와 지방교육자치 통합의 문제에 관한 소고- 교육감을 매개로 한 지방자치와 교육자치 연계․통합 논의를 중심으로 -

최근 헌법개정논의의 중심에는 정부형태 뿐만 아니라 지방분권에 관한 논의가 대세를 이루고 있다. 지방분권은 곧 지방자치의 실질화를 의미하는 것이기에 지방자치 개념을 어떻게 이해하느냐에 따라 ‘지방분권’의 형태는 달라 질 수 있다. 특히 지방자치와 교육자치, 지방자치와 지방교육자치의 관계를 정립하지 않고는 지방분권의 논의가 제대로 이루어 질 수 없다. 최근 지방자치와 교육자치의 관계에 관한 논의는 지방자치와 지방교육자치의 연계․통합에 관한 논의를 중심으로 해서 이루어져 왔다. 지방자치와 지방교육자치의 연계․통합에 관한 논의는 2010년 「지방교육자치에 관한 법률」 개정과 2013년 「지방분권 및 지방행정체제개편에 관한 특별법」이 제정되면서부터 본격적으로 시작하였는데, 그 논의는 주로 교육감 선출방식을 중심으로 한 양자의 연계․통합의 문제로 모아지고 있다. 교육감의 선출방식을 통한 연계․통합에 대한 논의는 지방교육발전에 필요한 다양한 교육적 자원을 효율적으로 확보하기 위하여 지방자치단체로 부터 교육에 대한 관심과 협력을 획득할 수 있다는 점에서 그 필요성은 인정될 수 있다. 그러나 이 경우에도 교육자치 행정상의 사무 처리의 합리성과 효율성을 제고할 수 있다고 판단되는 경우에 한해서 연계․통합의 필요성이 인정될 수 있을 뿐이다. 그러나 그 논의가 오히려 지방교육자치의 자주성․전문성․정치적 중립성을 약화시켜 교육자치의 독자성을 사실상 부정하는 쪽으로 진행된다면 문제가 되지 않을 수 없다. 따라서 지방자치와 지방교육자치의 연계․통합의 논의는 지방자치로 부터 교육자치 이념을 긍정하면서 교육자치행정의 특수성을 인정하는 데서부터 시작하여야 할 것이다.
Abstract
This study is to discuss about the problems within connection and integration between Self-Government of Education & Local Autonomy. We seek to rationally reform the powers and responsibilities of the National and local government as well as harmonizing the functions of the National and local government organizations. Since the enactment of the “Act on the Transfer of Central Administrative Authorities to the Local Government” in 1999, the government has continuous endeavored for decentralization for the past fifteen years. However, in reference to the general national affairs, the percentage of local autonomous affairs are still minimal, and local governments have unsuccessfully pursued to transcend from the central government oriented distribution of power. The enactment of “Special Act for the Reformation of the Local Administrative System” in 2010 have provided the necessary foundations for discourse on the construction of advanced local administrative system reflecting the characteristics of Korean governance. Therefore, by providing reformation plans for not only the integration of cities/counties/boroughs and reforming the autonomous administrative districts of special and metropolitan cities but also introducing autonomous policing system, realizing autonomous education system and integrating local government, thus contributing to promotion of benefits and welfare of the local citizens as well as effectuating local administration and reinforcing the competitiveness of local government. Especially, decentralization policy regarding education autonomy and local autonomy is interrelated task, but It is absolutely wrong to subordinate education autonomy to local autonomy. Therefore, the discussion of connection and integration between Self-Government of Education & Local Autonomy should begin with agreeing the idea of education autonomy from local autonomy and accepting distinctiveness of self-government of education
