EU의 경쟁적 협의제도에 대한 연구

초록
「사회기반시설에 대한 민간투자법」(이하 민간투자법)상의 사업자지정방식은 복수의 협상대상자로부터 민간투자사업실시와 관련한 혁신적 아이디어를 도출해내는 데에 한계가 있고, 실질적 경쟁의 효과를 거두기 힘들다는 점에서 비판의 대상이 되어 왔다. 이에 따라 사업자지정방식의 개선에 대한 논의가 지속적으로 이루어져왔고 이에 따라 2015년에는 민간투자사업기본계획에서 ‘경쟁적 협의’제도를 도입하였고(민간투자사업기본계획 제147조), 2016년도에는 ‘경쟁적 협의절차에 관한 세부요령’도 마련되었다. 이러한 경쟁적 협의제도의 모태가 된 것은 EU 공공조달지침의 경쟁적 협의절차이다. EU의 경쟁적 협의절차는 2004년 공공조달지침과 2014년 공공조달지침의 두 차례 개정을 거치면서 지속적으로 개선되어 왔는데, 이 과정에서 복잡한 계약의 특성에 맞는 ‘탄력성’을 확보하는 것과 사업자들의 영업비밀을 적절하게 보장하는 ‘공정성’을 확보하는 것이 균형이 이루는 방향으로 경쟁적 협의절차가 발전해왔음을 볼 수 있다. 또한 EU 회원국 내에서는 ‘자신만의 해결책 모델’(own-solutions model), ‘지정된 해결책 모델’ (designated model), ‘복합모델’(hybrid model) 등 다양한 모델의 경쟁적 협의절차가 운영되고 있다. 우리나라에서도 경쟁적 협의절차를 운영함에 있어서 이러한 EU법제의 운영경험을 참고로 하여 탄력성과 공정성이 균형을 이루면서, 우리나라 실정에 맞는 모델을 채택할 필요가 있다고 하겠다.
Abstract
Current PPP(Public Private Partnership) project operator selection method in ‘Act on Private Investment toward Infrastructure’ has been criticized that it is not effective to produce innovative idea and allows limited competition between bidders. To address these problems, there were many debates on reforming project operator selection method, and as a result, ‘competitive dialogue procedure’ were introduced in ‘Basic Plan on Private Investment Project’ in 2015. ‘Guidelines of Operating Competitive Dialogue’ was also adopted in 2016. This new selection methode was modeled after competitive dialogue procedure in European Union (EU) Public Procurement Directive. EU’s competitive dialogue procedure were developed through revision of both directives in 2004 and 2014. The main characteristic of this development was balancing between flexibility and fairness. And various competitive dialogue models, such as ‘own-solutions model’, ‘designated model’, ‘hybrid model’ were conducted in EU Member States. EU’s experience of conducting these procedures shows many implications to Korea such as balancing flexibility and fairness and adopt adequate model to Korea’s economic and social context.
