지방분권에 있어서 재정의 역할

시민들의 백만 촛불은 중앙집중적인 권력을 타파하고 민주적인 소통의 시스템을 구축하는 등 총체적인 제도개혁을 통하여 주권자인 국민에게 권력을 다시 돌려줄 것을 요구하고 있다. 이로써 그 동안 국가주도의 경제성장모델로서 재벌과 유착하여 경제를 이끌었던 패러다임의 전환을 필요로 하고 있다. 그러므로 국가주의 패러다임에서 벗어나 새로운 시스템을 구축하고 국가권력기구 및 국가재정의 역할과 기능을 새롭게 정립하여야만 적폐로 쌓인 모순을 극복할 수 있을 것으로 보인다. 이를 위한 방안은 다양할 것이나 그 방법 가운데 하나로써 현재와 같은 중앙집권적 권력구조를 지방분권적 권력구조로 개편하는 것이 긴요하다. 국가는 국가 전체적으로 통일성을 가지고 추구해야할 기능을 중심으로 권한을 담당하고 나머지 권한은 지방에 포괄적으로 이양함과 동시에 재원까지도 이양하는 것을 포함하여 대대적인 개혁이 행해져야 한다. 국가와 지방의 권한분배에 있어서는 입법권과 행정권뿐만 아니라 재정권까지도 각자가 가진 권한과 기능을 잘 수행할 수 있도록 적절하게 배분되어야 한다. 이를 통한 궁극적인 목표는 국가전체의 발전과 더불어 구성원인 국민들의 삶의 질을 향상시키는 것이 되어야 한다. 지방분권과 재정의 역할은 그러한 취지와 방향을 목표로 하여야 한다. 이를 위한 하나의 방안으로서 지방자치단체가 국가의 입법이나 정책에 참여하여 구속적으로 의사를 결정하는 구조가 필요하다. 그밖에 예산법률주의의 도입이나 국민들이 참여하고 정보를 공유할 수 있는 다양한 방법들이 강구되어야 한다.
Abstract
The million candles of citizens in Korea who have been sparked by the so-called ‘Choi Soon-sil Gate’ are demanding that the sovereign citizens return their power through comprehensive institutional reforms, such as breaking centralized power and building a system of democratic communication. As a result, Transition of the paradigm, which has led the economy through coalescence with the ‘chaebol’ as a model of economic growth, is required. Therefore, it seems to be able to overcome the accumulated contradiction by the abolition of the old paradigm and by establishing a new system and establishing the roles and functions of the state power organization and the state finances. There are many ways to do this. However, as one of the methods, it is essential to reorganize the current centralized power structure into a decentralized power structure. The state should take charge of the functions to be pursued with unity throughout the country. Major reforms should be undertaken, including transferring the remaining powers to the province comprehensively as well as transferring resources. In the allocation of powers between the state and the province, not only the legislative and executive powers but also the financial powers should be appropriately distributed so that they can perform their authorities and functions well. The ultimate goal of this should be to improve the quality of life of the people who are members, along with the development of the whole country. The role of decentralization and financing should aim at this purpose and direction. Here, I have mentioned some considerations in that regard. In particular, it is necessary to have a structure in which local governments participate in national legislation or policies and determine their opinions in a binding manner. It should be explicitly legislated to distribute the allocation of resources between the state and municipalities equally from the beginning. The introduction of budget law and the various ways in which the public can participate and criticize should be introduced.
