정보사회의 새로운 가치를 규범화하는 헌법개정의 형태

1987년부터 시행된 현행 한국 헌법은 여러 가지 값진 가치를 담고 있지만, 오늘날에는 현대사회의 변화상을 새롭게 받아들여야 할 필요성이 있다는 점을 부인할 수 없다. 현대사회의 변화는 여러 가지로 나타나고 있지만 그 중에서 정보사회의 등장이 가장 대표적이라고 할 수 있으며, 정보사회의 형성과 발전은 헌법상 수용이 시급한 대표적인 사회변화라고 할 수 있다. 이에 따라 정보사회의 형성과 발전이 사회변동의 일종이라는 점에 주목하여 사회변동의 헌법상 수용 문제를 논의의 출발점으로 하여 정보사회의 새로운 헌법현실을 헌법적으로 수용할 필요성을 제시하였다. 이어서 정보사회의 형성과 발전에 따른 헌법적 차원의 규범적 문제는 헌법의 가치체계에 변화를 가져오는 중대한 사회변동이기 때문에 헌법해석과 헌법변천만으로 해결하기에 충분하지 않고, 새로운 헌법적 가치의 정립을 위한 헌법개정이 필요하다는 점을 논증하였다. 그 다음으로는 헌법개정에서 정보사회의 형성과 발전에 따른 새로운 헌법적 가치가 어떠한 형태로 규범화될 수 있는지를 검토하고 그러한 규범화의 형태별 필연성 및 적절성 여부를 분석하여 헌법개정의 우선순위를 도출할 수 있는 방안을 제시하였다. 현 시점에서는 정보사회에 대한 헌법적 대응을 위하여 헌법상 정하는 국가목표를 헌법개정의 가장 우선적인 대상으로 하여 국가가 정보사회의 바탕이 되는 정보통신의 기반을 구축하고 보호하는 것을 목표로 하도록 하는 것이 적절하며, 향후 정보사회의 발전에 따른 새로운 가치들의 중요성과 필요성이 더욱 확고해지면 새로운 기본권 또는 제도보장을 신설할 수 있을 것이다.
Abstract
Although the current Korean Constitution, which has been in effect since 1987, contains many important values, it cannot help accepting the changes of society today. The emergence of information society is one of the most representative of the changes in modern society. The formation and development of the information society is a social change urgently required to be accept in the Constitution. Accordingly, this paper proposes the necessity of constitutional acceptance of the new constitutional reality of information society as the starting point of discussion. The constitutional normative problem due to the formation and development of the information society is a serious social change that is not enough to solve in the way of constitutional interpretation or constitutional change, because of change of constitutional value. So a constitutional revision is necessary. In the constitutional revision, the form of the new constitutional values in information society can be codified into various forms. It is needed to analyze which normative form has the inevitability and appropriateness to determine the priority of constitutional revision. At this time, for the constitutional response to the information society, the form of state objective should be the first priority of the amendment of the Constitution. It aims to establish and protect the foundation of information and telecommunications. If the importance of new values in information society becomes more substantial in the future, it will be able to establish new basic right or system guarantee.
