현대 영미 법철학에 있어서 분석철학의 영향

법철학은 당대의 주류 철학에 지대한 영향을 받으면서 발전해왔다. 현대 영미 법철학 역시 예외가 아니어서 동시대의 영미철학을 지배한 분석철학(analytical philosophy)의 영향을 받으면서 발전해 왔다. 분석철학의 성과를 도입하여 법철학을 발전시킨 대표적인 인물은 하트(H. L. A. Hart)이다. 옥스퍼드 대학을 중심으로 형성되었던 일상언어학파(ordinary language school)의 일원이기도 하였던 그는 오스틴(J. L. Austin), 헤어(R. M. Hare), 바이스만(F. Waismann), 윈치(P. Winch) 등의 논의를 적극적으로 수용하여 자신의 이론을 전개해나갔다. 하트 이후 영미법철학은 여전히 분석철학의 성과들을 적극적으로 도입하면서 하트의 논의를 비판하기도 하고 그것을 보완하거나 발전시켜나가고 있다. 이 글에서는 이러한 현대 영미 법철학의 모습을 그려내고자 하였다. 이를 위하여 먼저 제2장에서는 분석철학을 설명하고자 하였다. 또한 제3장에서는 하트가 분석철학의 어떠한 성과를 어떤 방식으로 응용했는지를 구체적으로 살펴보았다. 끝으로 제4장에서는 하트 이후에도 영미 법철학이 여전히 분석철학으로부터 영향을 받고 있는 모습을 기술하였다.
Abstract
Philosophy of Law has been developed greatly being influenced by mainstream philosophy. As contemporary Anglo-American philosophy of law is no exception, it has also been developed being influenced by analytical philosophy which dominated Anglo-American philosophy. The representative person who has introduced the achievements of analytical philosophy and developed philosophy of law is H. L. A. Hart. He, who was also a member of Ordinary Language School, actively accepted arguments of philosophers such as J. L. Austin, R. M. Hare, F. Waismann, and P. Winch and developed his own theory. After Hart, Anglo-American philosophy of law has been introduced the achievements of analytical philosophy. In chapter 2, I tried to explain what analytical philosophy of law is. In chapter 3, I looked into what achievements of analytical philosophy Hart applied and how he did it. Lastly, I tried to show that Anglo-American philosophy has still been influenced by analytical philosophy.
