불법행위를 목적으로 창단된 장애인 실업팀에 관한 법리 연구

초록
본 연구는 불법행위를 실질적인 목적으로 하여 설립된 장애인 실업팀에 관한 법리들을 해석하고 연구하고, 또한 그 향후 대책에 대하여 제언을 하는데 그 목적이 있다. 이러한 목적을 달성하기 위하여 체계적 문헌 고찰법을 사용하였다. 우리나라에서 장애인 실업팀은 장애인의 기초적인 복지 등 공익을 주된 목적으로 하고 있다. 일반적으로 우리나라의 장애인 실업팀들은 정부나 혹은 장애인 스포츠 활동이나 장애인 복지에 개별적으로 관심이 많은 기업에서 그 후원을 담당하고 있으며 이렇게 후원된 재정적 기초를 바탕으로 장애인 실업팀들이 운영되고 있다. 하지만, 이러한 장애인 실업팀이 특정 개인들의 불법행위를 실질적인 목적으로 하는 가운데 설립되었다면, 이는 하나의 심각한 문제로 변모된다. 게다가 이보다 더 큰 문제는 우리나라에서 이와 관련된 선행연구는 존재하지 않았으며, 또한 이 단체에 대하여 향후 방안조차 존재하지 않아 자칫하면 장애인 복지를 위하여 책정된 사업이 일개 불법행위로 치부되어버릴 수 있다는 점이다. 본 연구의 말미에는 이러한 상황의 재발을 방지할 수 있는 제언을 제시하였다.
Abstract
This research was conducted with legal knowledge based on Korean positive law and suggested several suggestions in the end of the research and the systematic review methodology was used to accomplish the purpose. Business sport teams in Korea for disabled are established on the public interests as fundamental welfare realization for disabled. With this reason, the Korean government and corporations, have high level interests on the welfare for disabled and abilities to support them in good parts, take the charge of the management of the business sport teams in Korea. However, if a business team was founded with a purpose of criminal torts like financial crime, it would be transformed to severe social and legal problem. Therefore, two worse problems that these type study never been conducted so far regarding disabled business sport team and any policies to control this kinds of risks also never been existed so far were discovered. Possibility of regarding as just a illegal organization of legal disabled business sport organization is another problem. End of this research several suggestions to prevent of recurrent were proposed.
