중국어선 불법조업에 대한 대응전략 연구

초록
우리나라 관할해역에서 중국 어선들의 불법조업과 이를 단속하려는 해양경찰에 대한 저항이 점점 지능화 그리고 흉포화 되고 있다. 단속 수위를 높여도 불법조업 중국 어선들의 숫자는 증가하고 있으며, 이제는 단순 불법조업일 뿐만 아니라 치어와 산란기 어종도 잡아가고 금어기에도 어장에 침입하여 조업을 하고 한국 어민들의 어구까지도 망쳐 놓는 불법행위가 계속되고 있다. 또한, 집단적인 저항에 단속 경찰관의 사망, 부상에 이어 고속단정 침몰까지 발생하였지만 무장을 갖추고도 적극적으로 대처하지 못한 국가 공권력과 해상치안 단속에 대하여 국민들의 질타가 빗발치고 있다. 이에 본 연구는 우리 주변 해역에서 발생하고 있는 불법조업 현황과 실태를 분석하여 매년 되풀이 되는 대응방법의 차원을 넘어 국가의 안위와 해양경찰 개개인의 생명을 보호하기 위하여 현 시점에서 기존 연구 자료를 바탕으로 전반적인 문제를 분석하여 불법어선 단속 체계와 효율적 대응전략 구축을 위한 방안을 통하여 해양경찰의 보다 나은 불법어선 단속과 제도의 방향을 제시하고자 하였다.
Abstract
The illegal fishery by chinese fishing vessels and their struggling against a KCG’s law enforcement is getting sophisticated and brutalized in our maritime jurisdictional waters. A numbers of illegal chinese fishing vessels have been increased although KCG has reinforced the law enforcement tools. In addition, they have invaded continuously our fishing ground during a closed season for fishery and fishes’ spawning season, captured even a fry, and ruined a fishing gears of our fishermen. The Korean people criticized the governmental authority and public safety control which have not responded actively to the collective resistance by illegal chinese fishing vessels caused the injury or death of Police Officers and sink of high-speed craft of KCG, even though they have proper equipments and weapons to crackdown on them. Thus, this study examines current status of illegal fishery in our maritime jurisdictional waters and analyses general problems of KCG’s controlling system against illegal fishery, according to the previous studies, to find a better solution to protect of nation’s safety and Officers’ safety. And finally it proposes a better control system of KCG for illegal fishery through establishing efficient controlling system and countermeasure against illegal fishery.
