위치측위기술(LBT) 발전에 따른 개인위치정보 보호방안에 관한 고찰

In many countries all over the world, the recent development of science and technology such as LBT(Location based on Technology) will improve our lives to a certain point, but there will also be negative side effects like the infringement of personal location information. Like most other countries, LBT short for “Location based on Technology” is spreading rapidly throughout South Korea. And the risk and danger of specific personal data such as personal location information infringement is expected to go up exponentially. For example, personal information especially personal location information could be collected by “Pokemon Go”　game company in real time when people use “Pokemon Go” Game. But the lack of protection of personal location data, constitutional rights such as privacy and secrecy, humag dignity etc. could be in danger all the time. Likewise, the fact that there is adequate protection laws and system for personal location information. In this situation, nation should take appropriate steps to protect the personal location information in many diverse area. Therefore national organization and people should try to come up with solution to any of the harmful side effects and to realize the secure environment to use LBT. Above all, personal location information which is any data processed in an electronic communication system indicating the geographical situation of user of communication service or network such as longitude·altitude·direction·latitude etc. are based on fundamental rights such as the freedom of privacy and secrecy and human dignity. It means that infringement of personal location information is a matter of privacy and human dignity. As a result, nation should stop violation of personal location information by improving individual location information related 0laws and system. Therefore recent law and system for personal location information should be improved to prevent infringement of fundamental human rights like individual location data. Furthermore the legislative branch should make legal system regarding personal location information like 「An on Protection and Use of Location Information」·「Personal Information Protection Act」·etc better. to guarantee the constitutional rights such and freedom of privacy and realize constitution-friendly science technology society based on the value of human dignity.
