학대피해노인의 보호를 위한 방안

초록
고령화 사회로 진입하면서 노인에 대한 범죄가 대폭 증가하면서 심각한 사회문제로 대두되고 있다. 중앙노인보호전문기관의 자료에 따르면 2005년 2,038건이던 학대피해노인이 2015년에는 3,818건으로 약 2배 가까이 증가 하였다. 하지만 노인학대에 대한 대책과 법률은 여전히 제대로 정비가 되지 않은 채 사실상 방치되어 있는 실정이다. 따라서 학대피해노인의 수가 증가하고 있고, 학대의 정도도 심각해지고 있는 노인학대의 방지를 위한 대책의 강구가 시급히 요구된다. 우선 노인학대 예방을 위한 제도적 방안으로서 노인학대 신고 기관의 확대, 노인학대 피해 예방을 위한 지원프로그램의 활성화가 요구된다. 또 노인학대 피해자의 지원에 관한 절차적 구제방안으로는 노인학대 피해자 지원을 위한 변호사제도의 도입 및 노인학대범죄사건의 사법처리절차에 있어서의 학대피해노인의 보호책 마련과 노인관련 전문가 참여의 확대가 필요하다. 그리고 학대피해노인의 지원에 관한 사후적 구제방안으로는 학대피해노인의 체계적 사후관리를 위한 지원의 확대, 범죄피해자 보호법상 구조금지급의 근거를 마련하기 위한 입법의 정비 등을 들 수 있다.
Abstract
With entering aging society, a crime against the elderly is emerging as a serious social issue. Especially, a problem of elder abuse increased dramatically. According to the data by Korea Elder Protection Agency, the elderly with mistreatment damage grew by about twice from 2,038 cases in 2005 to 3,818 cases in 2015. However, it is the real situation that is not properly maintained a countermeasure and a law on elder abuse. For this reason, a law pertinent to elder abuse was examined. The problems were proposed according to type, present status, and characteristic of the elderly with mistreatment damage. As an institutional plan for preventing the elder abuse in order to arrange a prevention and a countermeasure of elder abuse, it inquired into the expansion in the elder abuse report agency and the activation of a support program for preventing elder abuse damage. A procedural relief plan of a support for elder abuse victim was presented the introduction of a legal system for propping up the elder abuse victim and the expansion in an elder protection expert in light of a criminal procedure for giving aid to the elder abuse damage. Finally, a plan of posterior relief in terms of supporting an elder abuse victim was discussed a plan for supporting a victim aiming at a systematic follow-up control of the elderly with mistreatment damage and a scheme of the management according to the limitation of a compensation system in light of the Crime Victim Protection Act. The provision is important in relation to the handling procedure on a prevention and a countermeasure of the elder abuse crime. But a consideration is needed on what a law and a policy are in reality for the elderly with mistreatment abuse and their families along with a characteristic of elder abuse. And the elderly with mistreatment damage are thought to be necessarily prevented by reinforcing a support and a protection for elder victims through securing budget together with the development and the operation in a legal procedure and many programs.
