북한이탈주민의 헌법상 사회적 기본권 실현을 위한 북한이탈주민의 보호 및 정착지원에 관한 법률 개정 논의 -정착지원에 대한 욕구조사를 바탕으로-

The study aims to find the direction of the revision of North Korean Refugees Protection and Settlement Support Act for the realization of north korean defectors‘ social rights in the Constitution. For these purposes, this study reviews the results of the need survey regarding the North Korean Defectors in Buchun city, Gyeonggi Province. And Comparison and analysis Social Welfare Services Act, Multicultural Families Support Act and Act on Support for Welfare and Self-Reliance of the Homeless, etc with North Korean Refugees Protection and Settlement Support Act is carried out. As a results, in the case of a relatively low age group of refugees, the act should be amended to take precedence over education assistance, school life adjustment, and employment assistance. The mandatory regulations of cooperation between state, local governments and private organizations must be established in the provisions of employment aid of the act. Like the Multicultural Families Support Act, the act should provide the shared responsibility of state and local governments for the north korean refugees’ settlement. Also, provision of local adaptation centers, reinforcement of civil servants’ competence, securing professional personnel to associate with private organizations and the education for people’s understanding of north korean refugees should be established. The comprehensive plan, formulation, implementation, etc for residential settlement support must be revised such as Act on Support for Welfare and Self-Reliance of the Homeless, etc and cooperation obligation with private organizations should be set. This discussion will be helpful to north koreans’ growth as a critical human resources for the preparing of the mass exodus of refugees from North Korea and Korea Unification.
