2015년 12월 12일 프랑스 파리에서 개최된 유엔기후변화협약 제21차 당사국 총회는 파리협정(Paris Agreement)을 채택하여 신기후변화체제(Post-2020 Climate Change Regime)의 서막을 올렸다. 그리고 파리협정은 당초 2020년 발효될 것이라는 예상 보다 훨씬 빠른 2016년 11월 4일 발효되었다. 파리협정의 성공여부는 참여국가의 수 및 구체적인 목표설정과 더불어 설정한 목표에 대한 이행 및 준수에 달려 있다. 이 논문에서는 이들 중 국제법적 측면에서 검토되어야 할 준수 메커니즘을 다룰 것이다. 이러한 작업에 앞서 먼저 MEAs의 준수 메커니즘에 대한 일반론을 개관한다. 이러한 검토는 실효성 있는 파리협정 준수 메커니즘을 설계하고 수립하는데 필수적인 작업이라고 생각한다. 따라서 이러한 검토에 이어서 파리협정 준수 메커니즘과 관련한 국제법적 쟁점을 분석하면서 필요한 경우에는 향후 후속협상에 고려되어야 할 사항을 제안하고자 한다. 신기후변화체제의 기본방향을 정하고 있는 파리협정은 법적 구속력 있는 문서로서, 촉진적 성격의 준수 메커니즘의 설립할 것을 명문화하고 있다. 준수 메커니즘은 구속력 있는 국제적 합의의 중요한 요소이다. 그런데 파리협정은 촉진적인 성격의 준수 메커니즘을 설치한다는 기본 방향만 명문으로 규정하고 있고, 구체적인 내용은 결여되어 있다. 따라서 준수 메커니즘의 적용 범위, 담당 기관의 권한, 운영 절차 등에 대해서는 후속협상을 통해서 결정되어야 할 과제이다. 결론적으로, 신기후변화체제에서 파리협정 준수 메커니즘은 중요한 기능을 수행할 수 있도록 수립되어야 한다. 특히, 준수 메커니즘은 기후변화문제에 협력을 안정화시키고, 신뢰를 구축하고 유지하도록 하며, 역량 문제를 해결하고, 규칙을 명확히 하고, 무임승차로부터 보호하여 효과적인 이행을 강화한다. 따라서 준수 메커니즘은 그자체로 신기후변화체제의 필수적인 구성 요소가 될 것이다.
Abstract
The 21st Conference of the Parties to the United Nations Framework Convention on Climate Change (UNFCCC) held on 12 December 2015 in Paris, France adopted the Paris Agreement and made a prelude to the Post-2020 Climate Change Regime. And the Paris Agreement entered into force on November 4, 2016, much earlier than anticipated that it would come into force in 2020 The success of the Paris Agreement depends on the number of participating countries and on the implementation and adherence to the goals set, as well as on the specific goal setting. This article will deal with the compliance mechanisms that should be examined in terms of international law.First, I will outline the general theories of compliance mechanisms of MEAs. I think this review is an essential task in designing and establishing a effective compliance mechanism. Following this review, I will analyze the international legal issues related to compliance mechanism under the Paris Agreement and, if necessary, propose some points to be considered in future negotiationsThe Paris Agreement, which sets the basic direction of the post-2020 climate change regime, is a legally binding document that provides the establishment of a compliance mechanism with a facilitation in nature. The compliance mechanism is an important element of binding international agreement. However, the Paris Agreement stipulates only the basic direction of establishing a compliance mechanism of a facilitation in nature, and lacks specific details. Therefore, the scope of the compliance mechanism, the capacity of the committee, and the operational procedures should be determined through follow-up negotiations.In conclusion, the mechanism of compliance with the Paris in post-2020 climate change regime should be established to perform important functions. In particular, compliance mechanisms strengthen effective implementation by stabilizing cooperation, building and maintaining confidence in climate change issues, addressing capacity issues, clarifying rules and protecting against free riding. Thus, the compliance mechanism itself will be an essential component of the post-2020 climate change regime.
