사형제도의 위하력 효과에 대한 연구의 최근동향: 미국에서 발표된 선행연구를 중심으로
Recent Trends in the Empirical Studies of the Deterrent Effect of the Death Penalty on Homicides: Focusing on the Empirical Studies of the United States of America

현재까지 국내에서는 사형의 살인범죄억제효과에 대한 계량적 연구가 거의 전무한 실정이다. 본 연구의 목적은 미국 내에서 발표된 사형의 살인범죄억제효과에 대한 선행연구를 종합적으로조사보고하고, 한국에의 시사점을 제안하고자 하는데 있다. 이를 위하여, 본 연구에서는 미국학술지에 게재된 연구논문을 사용하여 선행연구논문에서 사용된 조사방법을 중심으로 분석하였다. 과거 연구논문에서 사용되었던 조사방법에 대하여 다음과 같은 순서로 정리하였다: (1) 연구 설계디자인 (research design), (2) 연구 데이터 (research data), (3) 중요 독립변수(the main independent variable of interest), (4) 종속변수 (dependent variable), 그리고(5) 통제변수 (control variable). 추가로, 사형 제도를 주제로 발표된 국내연구의 동향도 분석하였다. 이러한 연구 결과를 바탕으로 향후 국내 사형제도에 관련된 연구에 대한 제언을 논의하였다.
Abstract
There has been little empirical research on the deterrent effect of capital punishment on homicide in South Korea. The main purpose of this study is to provide a comprehensive survey of prior research on the deterrent effect of capital punishment on homicide in the United States and its implications for South Korea. To this end, this study reviews the full range of research methods of the previously published econometrics studies in the United States. Research methods used in the previous studies are summarized in order: (1) research design, (2) research data, (3) the independent variable of main interest, (4) dependent variable, and (5) a list of control variables. In addition, this study presents a review of the recently published studies on capital punishment in South Korea. Based on the findings of this study, the suggestions for the future research in South Korea are discussed.
