민법에서의 「통지･고지･통고」에 관한 검토 및개정방향
A Study and Amendment Proposals Relating the “통지(Tongzy)･고지(Gozy)･통고(Tonggo)” in the Korean Civil Act

초록
우리민법전은 관념론에 기초하므로, 민법전 중의 단어･문구･문장 등의 의미와 성질을 밝히는 것은 아주 중요하다. 이 논문에서는, 우리민법에서의 「통지･고지･통고」의 의미･성질･異同 등을 밝히고 이에 관한 정부의 개정안을 비판적으로 살피면서 이를 기초로 그개정방향을 제시하였다. 개정방향으로는, 의사표시 자체인 통지는 의사표시로 개정하고, “의사표시의 통지”라는法文에서는 “의 통지”를 삭제하여 의사표시로 개정한다. 관념통지인 통지는 그대로 둔다. 또한 민법에서의 고지는 모두 관념통지에 해당한다. 이러한 고지는 관념통지인 통지와같으므로, 고지를 통지로 개정한다. 그리고 통고가 의사표시 자체인 경우에는 이를 의사표시로 개정하고, 「의사표시의 통고」라는 法文에서는 “의 통고”를 삭제하여 의사표시로개정한다. 그뿐만 아니라, “의사표시의 통지”와 “의사표시의 통고”에서 “의 통지”와 “의통고”를 삭제하지 않는 경우에도, 통고를 통지로 개정하여 法文을 통일하는 것이 바람직하다. 왜냐하면, 같은 의미･성질이면 法文에서 같은 용어로써 표현하는 것이 바람직하기때문이다.
Abstract
The Korean Civil Act Enacted in 1958, be in force since 1960. And then a full-scale amendment of the Korean Civil Act has been discussing hotly. But there has so far been no amendment on 「통지(Tongzy)･고지(Gozy)･통고(Tonggo)」 in the Korean Civil Act. And the amendment-problem on these won’t hardly been discussed in the civil law academic world. Even there has so far been no government’s revision bill on 「통지(Tongzy)･고지(Gozy)･ 통고(Tonggo)」. Accordingly, in this paper, I reviewed whether 「통지(Tongzy)･고지(Gozy)･통고(Tonggo)」 are used rightly in the Korean Civil Act. And in the case that these are not used rightly, I suggested right amendment proposals. In the Korean Civil Act, all of 「통지(Tongzy)･고지(Gozy)･통고(Tonggo)」 are translated into notice, notification etc. Therefore, the meaning of these 「통지(Tongzy)･고지(Gozy)･통고(Tonggo)」 are all the same in English. 1. 통지(Tongzy) After review of all the Tongzies in the Korean Civil Act, I suggested amendment proposals on the Tongzies that are provided in the Korean Civil Act Article 111 Clause 2 etc. 2. 고지(Gozy) After review of the Gozies in the Korean Civil Act, I suggested amendment proposals on the Gozies that are provided in the Korean Civil Act Article 559 Clause 1 Proviso etc. 3. 통고(Tonggo) After review of the Tonggos in the Korean Civil Act, I suggested amendment proposals on the Tonggos that are provided in the Korean Civil Act Article 313 etc.
