한국 후견제도의 운영과 가정법원의 역할

초록
획일적인 행위무능력자제도의 폐단을 줄이고자 도입된 성년후견제도는 단순히 금치산･한정치산이 성년후견･한정후견으로 명칭이 바뀐 것만을 의미하지 않는다. 정신적 제약을 가진 사람들의 의사를 존중하고 그들이 잔존능력을 최대한 발휘하면서 그들의 필요에 따라 자신의 속한 사회의 다른 구성원들과 대등하고 조화롭게 살 수 있도록 한다는 성년후견제도의 이념은, 그에 관한 법령의 제정과 적용, 후견 심판과 감독, 시스템의 구축과 개선 등 성년후견제도 운영의 모든 영역에서 충실하게 구현되어야 한다. 한편 법원은 성년후견제도의 시행으로, 일회적이고 수동적인 분쟁해결이라는 전통적인 재판 업무에 더하여, 장기간 동안 피후견인을 적극적으로 관리하고 개입하여야 하는 새로운 영역의 업무를 수행하게 되었다. 가정법원이 후견영역에서의 후견적･복지적 기능을 충실히 수행하는 것은 ‘사법복지’의 이념 하에 국민의 권익보호와 복리증진을 위한 사법부의 역할이 적극적으로 확대되고 있는 좋은 예이다. 이러한 상황에서 한국의 성년후견제도가 시행 후 4년에 가까운 기간 동안 어떻게 정착되고 운영되어 왔는지, 그리고 성년후견제도의 운영에 있어서 법원은 어떠한 역할을 담당하고 있는지 살펴보는 것은 의미 있는 일일 것이다.
Abstract
The guardianship system introduced to alleviate negative effect of the uniform incompetence system does not mean only the name change. The ideology of adult guardianship is to respect the will of those with mental constraints, to maximize their remaining capacity to meet their needs, and to let them live in harmony with other members of their society. This philosophy should be faithfully implemented in all areas of adult guardianship system administration such as the establishment and analysis of the law concerning it, guardianship trial and supervision, the system construction and the direction of improvement. Meanwhile, by enforcing the adult guardianship system, the courts have been carrying out new areas of affairs that require active management and intervention for a long period of time, in addition to the traditional judicial functions of one-off and passive dispute settlement. It is a good example that the role of the judiciary in protecting the rights and interests of the people and promotion welfare is expanding under the ideology of 'justice welfare' that the family courts fully perform the tutelage and welfare functions in the guardianship domain. Under such circumstances, it would be meaningful to research how the Korean adult guardianship system has been settled and operated for nearly four years after the enforcement and what role the courts paly in the operation of the adult guardianship system.
