특허권 침해에 대한 증액손해배상제도의 도입에 관한 연구

초록
최근 ‘하도급법’, ‘정보통신망법’, ‘신용정보법’, ‘개인정보보호법’과 같은 개별법에서 3배 배상제도가 신설됨에 따라 특허법에서도 증액손해배상제도를 도입해야한다는 목소리가 다시금 대두되고 있다. 우리법상 처음으로 특허법에 대한 증액손해배상제도의 도입이 논의되던 당시에는 대륙법계에 속하는 우리나라 법체계와의정합성 등을 이유로 반대하는 견해가 우세하였다. 그러나 그 후 사회적 측면에서나지식재산의 이용환경적 측면에서나 많은 변화가 있었다. 민법상 전보배상만으로는충분하지 않다는 인식이 확산되고, 사회적 합의하에 하도급법을 필두로 개별법에서다양한 형태로 증액배상제도가 도입되었다. 본 논문에서는 특허권침해의 특수성, 지식재산 이용환경의 변화와 현실적 필요성, 법경제적 관점 등에 비추어 특허법에도 증액손해배상제도를 반드시 도입할 필요가 있다고 제안하였다. 다만 특허법에도입될 증액손해배상제도는 이미 동제도를 도입한 하도급법, 정보통신망법, 신용정보법 및 개인정보보호법이나 동제도의 도입을 논의 중인 환경관련분야나 제조물책임법과는 도입의 취지 자체를 달리하는 것이므로, 해당제도가 산업발전이라는 특허법의 목적에 맞게 운용될 수 있도록 증액손해배상의 범위나 구체적인 적용요건을정할 것을 제안하였다.
Abstract
Recently, there have been many suggestions that the patent law should introduce an enhanced damages compensation system as ‘FAIR TRANSACTIONS IN SUBCONTRACTING ACT’, ‘ACT ON PROMOTION OF INFORMATION AND COMMUNICATIONS NETWORK UTILIZATION AND INFORMATION PROTECTION, ETC.’, ‘CREDIT INFORMATION USE AND PROTECTION ACT’ and ‘PERSONAL INFORMATION PROTECTION ACT.’ At the time when the introduction of the enhanced damages compensation system for patent law was discussed for the first time in Korea, the opinion opposing to that system on the grounds of consistency with continental law was dominated. However, there have been many changes since then in terms of social aspects and environment of utilizing intellectual property. As the result, the perception that the compensatory remedy alone is not sufficient in the civil law has spread. Under the social consensus, the supplementary compensation system was introduced in various forms in the individual law, starting with the ‘FAIR TRANSACTIONS IN SUBCONTRACTING ACT.’ In this paper, it is suggested that the enhanced damages compensation system must be introduced in the ‘PATENT ACT.’
