이 글은 최근 역동적으로 분출하고 있는 집단적 의사의 표현들을 어떻게 지속가능한 형태로 정치화시킬 수 있을 것인가 그리고 그 정치화의 한 방식으로서의 헌법화는 어떤 전제조건 위에서 구성되어야 할 것인가를 분석하고자 한다. 우리 헌정사는 운동에 의한 민주화라는 말이 정확하게 들어맞을 만큼 시민들의 응집된 힘으로 변곡점들을 만들어 왔다. 이번의 촛불집회 역시 마찬가지이며, 이런 국민적 저항은 우리나라의 대의체계 전반을 부정하는 한편, 새로운 의사결정체제를 구성할 것을 요구한다. 이 글은 이를 예외상태로 규정하면서, 시민들이 생활세계에서 형성하는 다중적 정체성을 그대로 유지한 채 정권뿐 아니라 국가 자체를 구성적 외부로 상정하면서 구성되는 연대의 정치를 추구하고자 한다. 즉, 시민들이 구성하는 갈등과 적대의 관계를 차이의 연대에 의하여 극복해 나가며 이 과정에서 헌법을 시민들의 헌법으로 재전유하는 헌법투쟁의 장을 만들어내고자 한 것이다. 그리고 이에 터잡아 직접민주제를 향한 체제개혁의 방안을 모색해 보았다.
Abstract
This article analyzes how the collective political demands in the recent dynamic candle rallies can be politicized in sustainable ways and how it should be structured into the constitutional system as a form of governance. The national protest calls for negation of the nation's overall political and economical system and requires a new form of decision-making. Defining such situation as Ausnahmezustand and analysing the governing powers and the regime as constitutive outside, this article defines the process of surmounting the conflict and antagonism as a significant political arena for defending the Constitution. Then, it seeks to reform the system for direct democracy.
