음악클럽 활성화를 위한 관련 법 개정방안에 대한 연구

Music Club serves as a distribution center for various music channels and contributes to cultural development through communicating with audiences. It also contributes to the revitalization of tourism and serves as a cultural hub in a related region. However, music clubs are mainly operating as general food stores, while they are regulated by Food Sanitation Law. It means that music clubs have been excluded from the government support policies related to the music industry.* Assistant Professor, Hansei University. Therefore, in order to support music clubs the related laws need to be revised. The amendments to the Music Industry Promotion Act(MIPA) are as follows. ① It is necessary to establish a definition of the music club so that the music club can be defined as musical performing business. ② The music industry should be added to the definition of musical performing business. ③ In order to help start-up music clubs business and support to develop their business, concrete support programs such as development of performance programs, promotion of performances, promotion of domestic and international support, and marketing and management etc. need to be noted in detail. ④ Designation grounds for excellent music clubs, such as music performance programs, should be established. The Framework Act on the Promotion of Cultural Industries needs to be revised to include cultural industry related facilities in the concept of the cultural industry promotional zone. On the other hand, there is a problem that according to the MIPA music clubs does not receive the benefit of the government when it convert a free music club to declaration in the future or registration business. Also, in this case music clubs easily subject to criminal punishment. Therefore, the legislation in this way should not be enacted.
