플라톤의 『법률』에 나타난 입법가의 참된 수사술

플라톤은 『법률』에서 시민들을 법적으로 강제하기에 앞서 충분한 ‘설득’의 과정을 거쳐야 한다는 견해를 편다. 이 점은 어떻게 시민들을 법에 복종하게 해야 하는가, 혹은 어떻게 시민들과 소통하며 통치를 해야 하는가 하는 문제와 연관해서 새롭게 주목을 받아 왔다. 그런데 ‘설득’은 바로 수사술의 기능이므로, 설득의 내용을 담고 있는 『법률』의 전문들은 입법가의 수사술이 활용된 것으로 보인다. 그리고 이때의 수사술은 『고르기아스』에서 비판의 대상이 되었던 전통적 수사술보다는 『파이드로스』에서 모색된 참된 수사술로 보는 것이 적절할 것이다. 이 논문에서는 『법률』의 전문들이 『파이드로스』에서의 참된 수사술이 활용된 좋은 사례들이라고 보고, 그 전문들을 설득의 측면에서 분석했다. 좀 더 구체적으로 말하면, 우선 『고르기아스』와 『파이드로스』를 통해 플라톤이 전통적 수사술의 어떤 점에 비판적이었는지, 그리고 참된 수사술이란 어떤 것인지를 살펴보았다. 그리고 그 참된 수사술이 『법률』에 어떻게 활용되었는지 알아보기 위해 전문들을 분석해서 논증이나 근거의 성격에 따라 설득의 종류들을 나누고, 이 종류들과 입법가의 참된 수사술의 관계를 검토했다. 이를 통해 기존 학자들과 달리 『법률』의 전문들에서 세 종류의 설득, 즉 ‘필연적 설득’, ‘개연적 설득’, ‘비논리적 설득’을 구분하고, 이 세 종류의 설득 모두 입법가의 참된 수사술과 연관된 것임을 밝혔다.
Abstract
This paper aims to consider how the true rhetoric outlined in the Paedrusis applied in the Laws. In this work Plato proposes attaching preambles tolaws in order to persuade citizens to obey laws voluntarily. Then, what kindof persuasion does Plato have in mind? There has been an argument aboutwhether it is rational or non-rational persuasion. I think that Plato has bothin mind. Because he used to appeal to citizens’ emotions or their reason, andeach of these have their function. In Book 9, he provides a preamble about‘voluntary murders’ in double form. In other word this preamble iscomposed of logical explanation (869e-870d) and religious exortation(870d-e). What does this mean? It seems that Plato considers the principleoutlined in the Paedrus, that different speeches are suitable for differentsouls. If so, various kinds of persuasions and souls will be found in thepreambles. I give attention to the three kinds of persuasions: necessary,probable, and illogical. I also argue that the lawgiver is true rhetor andapplies the three kinds of persuasions in order for citizens to obey laws andso be virtuous. Then, I show that the three kinds of persuasions are rhetoricalpersuasions.
