개정 의료법 제33조 제8항 본문의 중복개설금지: 이른바 네트워크(network) 병･의원을 중심으로

의료법 제33조 제8항은 의사 등 자연인이 의료기관, 즉 병･의원을 개설할 때에는 한 곳만을 개설할 수 있게 하고 있다(이른바 중복개설금지). 이 규정은 1994년 처음 우리 의료법에 들어왔으나, 판례가 약사법상 중복개설금지의 해석론을 원용하여 한 사람이 경제적으로 복수의 병･의원에 투자하여 수익을 얻고 있다 하더라도 구체적으로 각 병･의원을 서로 다른 의사 등이 관리하고 있다면 중복개설에 해당하지 아니한다는 매우 강력한 목적론적 축소를 행한 바람에 오랫동안 큰 기능을 하지 못하였다. 이 규정은 2000년대 이후 이른바 네트워크 병･의원의 유행과 함께 2012년 개정으로 이를 금지할 의도로 종전과 같은 내용을-표현만 약간 바꾸어-다시 입법하고, 그에 따라 검찰과 국민건강보험공단이 네트워크 병･의원에 대하여 강력한 제재를 가함에 따라 다시 중요한 의미를 갖게 되었다. 이는 무엇보다도 상업적 의료(영리의료)를 막기 위함이었다. 이 글에서는 중복개설금지의 해석론을 판례의 면밀한 분석과 법학방법론적인 관점의 반성을 통하여 재구성하고, 나아가 입법론적으로 중복개설금지가 필요하고 적절한 것인지, 우리 의료법의 기본구상에 비추어 비판적으로 검토하였다.
Abstract
Article 33, section 8 of Korean Medical Service Act forbids physician to establish and operate multiple heath care institutions–either hospitals or clinics. This provision, introduced in 1994, had, however, only marginal practical importance for a long time, because the Supreme Court interpreted this provision very narrowly, by the way of teleological reduction, leaving little room for application thereof. It led to the prevalence of a new business organization model, network hospital or clinic. This new model endangered independent physicians’ businesses in competition with networks. In 2012, members of the National Assembly submitted and passed a bill to revise the Medical Service Act to forbid this type of business model. From then on, prosecutors and National Health Insurance Service have enforced this regulation, and networks filed law-suits and constitutional petitions against those regulations. In this article, I examined whether the new provision or the interpretation thereof is agreeable in terms of jurisprudence and whether it is a justifiable policy.
