대의민주주의와 정당민주주의의 헌법적 정합성 확보 방안 ― 광장민주주의의 선별적 수용여부를 타진하며 ―

The Parliamentary impeachment of President Park Geun-hye in late 2016 about a series of corruption allegation together with her friend Choi Soon-sil has ended in removing the President by a Constitutional Court ruling that upheld the Parliament. Surrounding the whole situation, two kinds of protests rally, either opposing or supporting, held in our squares. Even some members of Parliament have participated in each different protest, either showing passive resistance or making active inflammatory speech as a demagogue. These two scenes remind me of participatory democracy similar like ancient Greek style democracy in Agora. I am afraid that these situations result form the crises of both representative democracy and party democracy mixing with people’s distrust and anger toward our current ossified political system. If we can coordinate both representative democracy and party democracy under our constitutional framework successfully, we would less experience that participatory democracy’s fatal weak points make an abrupt appearance to us. This article mainly deals with how to coordinate well both representative democracy and party democracy under our current constitutional framework even including absorbing participatory democracy’s good function. This article, first of all, analyses recent political phenomena showing diverse symptoms of the crises of both representative democracy and party democracy in Korea while searching the reasons of those. Next, this article suggests how to overcome the crises of both representative democracy and party democracy under current political system. In addition, this article tries to embrace the strong points of participatory democracy for fitting those into our current constitutional framework.
