홍콩의 법 교육 및 변호사 자격 취득 절차와 법률 서비스 시장에 관한 연구

On the ground of the Constitution of People's Republic of China("PRC"), National People's Congress enacted the Basic Law of the HKSAR, which had an effect from 1 July 1997 on the establishment of HKSAR. In accordance of Basic Law, fundamental principles of the common law such as 'the rule of law' will be continuously effective under the legal system in the HKSAR and previous laws are insured to be effective except any contradict to the Basic Law or subject to subsequent legislative amendment by the HKSAR. In Hong Kong, the legal profession in Hong Kong is clearly divided into two -barristers and solicitors. Barristers hold unlimited rights of audience in all courts and tribunals where they are to provide legal representation, while solicitors have limited rights of audience before court. Under the current system in Korea, there are increasing concerns that the law schools have a misplaced incentive to make students pass bar exams as many as possible, not able to provide them appropriate skills and knowledge required to meet standard for current legal service market. We should note the recent debates in Hong Kong on whether law schools play more active role to provide practice skills through the special course of law schools such as PCLL rather than within the academic law degree curriculum.
