어린이집 아동학대 사건 판례에서의 양벌규정 적용과 시사점

In Korea, child abuse by parents keeps decreasing each year, while abuse in child care centers is constantly on the rise. The Korean government is making efforts to prevent child abuse through diverse policies, but child abuse in child care centers occurs continuously, and it is becoming a social problem. This study collected and analyzed precedents related to child abuse in child care centers by searching Homepage of Supreme Court and each district court of different regions. Based on the information, this study figured out legal applications about child care teachers, and analyzed which punishment was imposed to each child care center director by the precedents applying joint penal provision. Thus, this study has significance in the sense that it analyzed for the first time precedents applying joint penal provision based on the child abuse cases occurred in child care centers. This study discovered deficiency of legal application with respect to directors who take real responsibilities of management of child care centers, and intended to contribute to providing the baseline data for preventing child abuse in child care centers and promoting healthy growth of children through legal and institutional arrangement.
